Peranan Kepolisian Dalam Penerapan Restorative Justice Terhadap Kecelakaan Lalu LIntas yang Menyebabkan Kematian di Wilayah Satlantas Polrestabes Medan

Abstract

Kepolisian Negara Republik Indonesia atau yang sering di singkat dengan Polri dalam kaitannya dengan pemerintah adalah salah satu fungsi pemerintahan negara dibidang pemeliharaan keamanan dan ketertiban masyarakat, penegakan hukum, perlindungan, pengayoman, dan pelayanan pada masyarakat. Bertujuan untuk mewujudkan keamanan dalam negeri yang meliputi terpeliharanya keamanan dan ketertiban masyarakat, tertib dan tegaknya hukum, terselenggaranya perlindungan, pengayoman, dan pelayanan masyarakat, serta terciptanya ketentraman masyarakat dengan menjunjung tinggi hak azasi manusia, hal ini terdapat dalam Pasal 4 Undang-undang Nomor 2 Tahun 2002 tentang Kepolisian Republik Indonesia. Dalam penelitian ini penulis mengambil permasalahan ialah Peranan Kepolisian Dalam Penerapan Restorative Justice Terhadap Kecelakaan Lalu Lintas Yang Menyebabkan Kematian diwilayah Polrestabes Medan dan Hambatan-hambatan yang dihadapi Kepolisian Polrestabes Medan Dalam Pelaksanaan Penerapan Restorative Justice terhadap kecelakaan lalu lintas.Penulis menggunakan metode penelitian empiris adalah penelitian yang diperoleh langsung yang diperoleh langsung dari masyarakat atau meneliti data primer jenisjenis penelitian hukum empiris terdiri dari penelitian terhadap identifikasi hukum (tidak tertulis), penelitian terhadap efektifitas hukum, penelitian berlakunya hukum positif, penelitian pengaruh berlakunya hukum positif terhadap kehidupan masyarakat, penelitian terhadap faktor-faktor non hukum terhadap terbentuknya ketentuan hukum positif. Hasil penelitian dalam karya ilmiah ini ialah Peran kepolisian polrestabes Medan dalam melaksanakan penegakan hukum dengan restorative justice antara lain :Sebagai fasilitator yang mengupayakan perdamaian diluar pengadilan; Memberikan kesempatan kepada pelaku tindak pidana untuk bertanggung jawab; Menyelesaiakan permasalahan hukum pidana yang terjadi diantara pelaku tindak pidana dan korban tindak pidana tersebut. Hambatan-hambatan yang sering dihadapi kepolisian Polrestabes Medan dalam penanganan laka lantas dengan pendekatan restorative justice, diantaranya adalah: Adanya pihak keluarga korban yang tidak ingin memaafkan pihak uarga korban menuntut nominal ganti rugi yang cukup besar; Masih adanya stigma negative dari masyarakat; Hambatan dari penegak hukum, ialah tidak ada payung hukum yang mengatur The National Police of the Republic of Indonesia or often in brief with the Police in relation to the government is one of the functions of the state government in the field of security and public order maintenance, law enforcement, protection, security, and service to the community. The obstacles often faced by medan police in the handling of laka then with restorative justice approach,among others are: The family of the victim who does not want to forgive the victim's uarga demands a considerable amount of compensation; There is still a negative stigma from society; The impediance of law enforcement, is that there is no legal umbrella governing the application of progressive laws through mediation in the settlement of criminal cases.
