Abstract: | Pertambangan merupakan usaha untuk menggali berbagai potensi yang terkandung dalam perut bumi salah satunya Penambangan Pasir. Maraknya Penambangan Pasir Ilegal disebabkan kurang tegas para Penegak Hukum serta hukuman yang rendah. Berdasarkan latar belakang penelitian ini menghasilkan tiga (3) permasalahan yang dibahas, yakni: 1) Bagaimana pengaturan hukum mengenai pertambangan pasir di Indonesia? 2) Bagaimanakah pertanggungjawaban pidana terhadap pelaku penambangan pasir ilegal menurut perundang-undangan Indonesia? 3) Bagaimana dasar pertimbangan hakim dalam menjatuhkan putusan terhadap pelaku penambangan pasir yang dilakukan secara illegal dalam Putusan Nomor 424/Pid.B/LH/2020/PN Kis?. Adapun metode penelitian yang digunakan di dalam penelitian ini yakni menggunakan metode yuridis normatif yang bersifat deskriptif analitis adalah penelitian hukum kepustakaan yang dilakukan dengan cara meneliti bahan-bahan hukum, asas-asas hukum serta peraturan hukum yang ada hubungannya dengan pokok bahasan.. Teknik pengumpulan data dilakukan dengan cara library research dan field research. Berdasarkan penelitian dapat disimpulkan sebagai berikut: (1) Pengaturan hukum pertambangan pasir di Indonesia diatur didalam, Undang- Undang No. 32 Tahun 2009 Tentang Perlindungan dan Pengelolaan Lingkungan Hidup, Undang Undang No. 3 Tahun 2020 Tentang perubahan atas Undang-Undang No. 4 Tahun 2009 Tentang Pertambangan Mineral dan Batubara, Peraturan Pemerintah No. 22 Tahun 2010 tentang Wilayah Pertambangan dan Peraturan Pemerintah No. 23 Tahun 2010 Tentang Pelaksanaan Kegiatan Usaha Pertambangan Mineral dan Batubara. (2) Pertanggungjawaban pidana terhadap pelaku penambangan pasir ilegal diatur dalam Pasal 158 Undang-Undang No. 4 Tahun 2009 tentang Pertambangan Mineral dan Batubara dengan ancaman pidana paling lama 10 (sepuluh) tahun dan denda paling banyak 10.000.000.000, 00 (sepuluh milyar rupiah) (3) pertimbangan hakim dalam menjatuhkan putusan Nomor 424/Pid.B/LH/2020/PN Kis terhadap Terdakwa Martinus Sitinjak dipidana Penjara selama 10 (sepuluh) bulan dan denda Rp 500.000.000,00 (Lima ratus juta Rupiah). Berdasarkan fakta persidangan melalui keterangan saksi, terdakwa dan alat bukti. Putusan Majelis Hakim dinilai terlalu ringan tidak mewujudkan tujuan pemidanaan itu sendiri untuk memberikan efek jera. Untuk itu disarankan Perlu dilakukan penertiban yang ketat oleh pihak penegak hukum terhadap penambang pasir illegal, hakim memberikan hukuman maksimal sesuai undang-undang yang berlaku dan Perlunya upaya pembahasan mempermudah perijinan. Mining is a full exploitation with efforts to take potential available contained in the earth, one of which is taking a sand mining. There are massive found illegal sand mining seemly due to not firmly enforcement and in lenient punishment. This study dealt with at least 3 matters focuses on : 1) How is law ruling on sand mining in Indonesia to apply ? 2) How is on criminal accountbility ruled to illegal sand miner should be apllied in Indonesia laws ? 3) What should be principle consideration based by judges to take verdict to those sand miner illegal practiced under adjudication No.424/Pid.B/LH/2020/PN Kis?. This study is a normative juridical research with an analitical description method. This study adopted a library law research in this case is to study more law materials, law principles as well as law ruling that correlated with the topic. In collecting the data, still adopted field research as well as. In this study can be taken conclusions as the followings : 1) Law regulations on sand mining in Indonesia has been ruled as found by Undang-undang No.32 of 2009 Regulations regarding Protection and the Environmental Management, still Undang-undang No. 3 of 2020 Regulations regarding the amendment to Undang-undang No.4 of 2009 Regulations on Mineral Mining and Coal, on Government Rules No. 22 of 2010 on Mining Region and to Government Rules No. 23 of 2010 regarding a Commercia Business activity of Mineral Mining and Coal. 2) Criminal accountability demand to those Illegal sand miners as ruled in Article 158 Undang-undang No. 4 of 2009 Regulations on Mineral Minings and Coal with a sentence at least 10 (ten) years threatened and with amount Rp.10,000,000,000.00 (Ten billion Rupiahs) fine, still (3) Got basic consideration by judges in taking adjudication as found in Case No, 424/Pid.B/LH/2020/PN Kis imposed punishment to Martinus Sitinjak with sending jail for 10 (ten) months prison and with Rp. 500,000,000 (five hundred million rupiah) fine. Seemly under the facts by trial in witnesses, defender and the evidences. Noted that adjudication by judges is seen lineant punishment for it is not enforcement to the purpose of sentencing to imprison a deterrent effect. For this reason, it is recommended that there should be strict control by law enforcement against illegal sand miners, the judge gives the maximum penalty according to the applicable law and the need for discussion efforts to facilitate licensing. |
