Abstract: | Tujuan penelitian adalah untuk mengetahui regulasi yang diterbitkan oleh pemerintah perihal operasional perusahaan, kontrak kerja serta bagaimana pelaksanaan hak dan kewajiban karyawan unit Aviation security (AVSEC) di masa pandemi Covid-19. Hipotesis penelitian adalah pemerintah mengeluarkan peraturan khusus di masa pandemi, terjadinya perubahan sistem kerja di dalam kontrak kerja, hingga menurunnya hak dan kewajiban karyawan. Subjek penelitian ini adalah karyawan yang berdampak langsung terhadap perubahan sistem kerja yang terjadi selama masa pandemi Covid-19 pada Bandar Udara Kualanamu Sumatera Utara. Metode analisis data dilakukan dengan teknik wawancara terhadap responden dan penelaahan kepustakaan.Dari hasil analisis maka ditemukan bahwa pemerintah melalui Menteri Ketenagakerjaan mengeluarkan regulasi khusus selama masa pandemi.Perusahaan melakukan perubahan kontrak yang disebut dengan Perjanjian Kerja Harian Lepas. Maka selanjutnya hak dan kewajiban karyawan di unit AVSEC adalah para pekerja hanya menerima upah sesuai kehadiran di lokasi kerja tanpa menerima gaji pokok dan tunjangan tidak tetap sebagaimana yang telah diatur pada perjanjian kerja sebelum terjadinya pandemi, dengan kata lain perusahaan telah memberlakukan asas “no work, no pay” yaitu upah tidak dibayar apabila pekerja/buruh tidak melakukan pekerjaan sebagaimana dijelaskan pada pasal 93 ayat (1) UU Ketenagakerjaan. The purpose of the study was to find out the regulations issued by the government regarding company operations, work contracts and how to implement the rights and obligations of employees of the Aviation security unit (AVSEC) during the Covid-19 pandemic. The research hypothesis is that the government issues special regulations during the pandemic, changes in the work system in work contracts, and decreases the rights and obligations of employees. The subjects of this study were employees who had a direct impact on changes in the work system that occurred during the Covid-19 pandemic at Kualanamu Airport, North Sumatra. The method of data analysis was done by interviewing the respondents and reviewing the literature. From the results of the analysis, it was found that the government through the Minister of Manpower issued special regulations during the pandemic. The Company makes changes to the contract which is known as a freelance daily work agreement. Then furthermore, the rights and obligations of employees in the AVSEC unit are that workers only receive wages according to attendance at the work site without receiving a basic salary and non-permanent benefits as stipulated in the work agreement before the pandemic, in other words the company has implemented the principle of "no work, no pay” i.e. wages are not paid if the worker/labourer does not perform the work as described in Article 93 paragraph (1) of the Manpower Law. |
