Abstract: | Metode penelitian yang digunakan adalah library Research ( Penelitian Kepustakaan) yaitu penelitian yang dilakukan berdasarkan sumber bacaan, yakni undang-undang, buku-buku, penelitian ilmiah, artikel ilmiah, media massa, dan jurnal hukum yang berhubungan dengan materi yang dibahas dalam proposal skripsi ini. Dalam penelitian ini mengandung data primer dan data skunder field research (Penelitian Lapangan) yaitu dengan melakukan Penelitian langsung kelapangan, dalam hal ini peneliti langsung melakukan penelitian ke Pengadilan Negeri dengan Nomor Putusan 421/PDT/2018/PT.Mdn dengan cara wawancara. Hasil penelitian ini adalah Bentuk Wanprestasi dalam perkara adalah berdasarkan ketentuan pasal 1313 Kitab Undang-Undang Hukum Perdata (KUHPerdata) dan berdasarkan ketentuan pasal 1238 KUHPerdata (Kitab Undang-Undang Hukum Perdata) bahwa wanprestasi hanya dapat terjadi setelah terlebih dahulu terdapat pihak yang melakukan perjanjian. Bentuk penyelesaian sengketa jual beli tanah pada putusan adalah menerima dan mengabulkan gugatan rekovensi sebahagian; dan menyatakan sah dan berkekuatan hukum penggugat rekovensi adalah pemilik sah atas 2 (dua) pintu bangunan ruko. Pembuktian telah terjadi wanprestasi dalam jual beli tanah pada putusan adalah Penggugat dengan Alm. Herman Wijaya dahulu yang telah membuat akta perjanjian bangun bagi yang dibuat dan ditandatangani di hadapan Rahanum SH Notaris tetapi setelah 6 bulan Alm. Melanggar ketentuan isi perjanjian bangun bagi nya. The research method used is library research, which is research conducted based on reading sources, namely laws, books, scientific research, scientific articles, mass media, and legal journals related to the material discussed in this thesis proposal. . In this study, it contains primary data and secondary field research data, namely by conducting direct research into the field. In this case the researcher directly conducts research to interviews. The result of this study are that the from of Default in the case is based on the provisions of article 1313 of the Civil Code (KUHPerdata) and based on tehe provisions of article 1238 of the Civil Code (Civil Law Book) that default can only occur after there is a party that makes an agreement. The from of settlement of the land sale and purchase dispute in the decision is to accept and grant the counterclaim in part; and to state that it is legal and legally binding. The counterclaim plaintif is the legal owner of 2 (two) shophouse doors. The proof that there has been a default in the sale and purchase of land in the decision is the Plaintiff and the late. Herman Wijaya was the first to make a deed of building agreement which was made and signed before Rahanum SH Notary but after 6 months the late. Violating the provisions of the building agreement for him. |
