Abstract: | Penerapan legal reasoning oleh hakim militer dalam mewujudkan kemanfaatan hukum terhadapat putusan perkara desersi sangat diperlukan untuk membedakan putusan bagi terdakwa yang hadir di persidang dan terdakwa yang tidak hadir di persidangan (in absensi). Tindak pidana desersi hanya dapat dilakukan oleh anggota TNI yang diatur dalam Pasal 87 KUHPM. Permasalahan dalam penelitian ini adalah bagaimana penerapan legal reasoning dalam mewujudkan kemanfaatan hukum oleh hakim militer terhadap putusan perkara desersi? Apakah kendala-kendala dalam penerapan legal reasoning dalam mewujudkan kemanfaatan hukum oleh hakim militer terhadap putusan perkara desersi? Metode yang digunakan dalam penelitian ini adalah penelitian yuridis normative. Sumber data yang digunakan dalam penelitian ini ialah sumber data sekunder. Teknik pengumpulan data dilakukan dengan dua cara, pertama penelitian kepustakaan, dan kedua penelitian lapangan. Penelitian ini menggunakan analisa data secara deskriptif. Berdasarkan hasil penelitian yang diperoleh, Hakim dalam memberi putusan akhir mempunyai legal reasoning tersendiri bagi terdakwa yang hadir di persidangan dan yang tidak hadir di persidangan dengan memberi pidana pokok dan pidana tambahan. Dalam menerapkan legal reasoning yang mewujudkan kemanfaatan ini, hakim sering mengalami kendala yaitu menunggu terdakwa untuk kembali pada kesatuan, dan dan adanya undang-undang yang mengatur penyelesaian tindak pidana desersi (pasal 143 undang-undang No. 31 tahun 1997 tentang peradilan militer) yang mewajibkan penyelesaian perkara selama 6 bulan. The application of legal reasoning by military judges in realizing the usefulness of law against desertion case decisions is very necessary to distinguish decisions for defendants who are present at trial and defendants who are not present at trial (in absenteeism). The criminal act of desertion can only be carried out by members of the TNI as regulated in Article 87 of the Criminal Procedure Code. The problem in this research is how is the application of legal reasoning in realizing the benefits of law by military judges on desertion case decisions? The method used in this research is normative juridical research. Sources of data used in this study is secondary data sources. Data collection techniques were carried out in two ways, firstly library research, and secondly field research. This study uses descriptive data analysis. Based on the results of the research obtained, the Judge in giving the final decision has its own legal reasoning for defendants who are present at the trial and those who are not present at the trial by giving the main and additional penalties. In applying legal reasoning that realizes this benefit, judges often encounter obstacles, namely waiting for the defendant to return to the unit, and There is a law that regulates the settlement of the crime of desertion (article 143 of Law No. 31 of 1997 concerning military justice) which requires the settlement of cases for 6 months. |
