Abstract: Pelaku usaha yang memanfaatkan situasi pandemi Covid-19 dengan melakukan beragam tindak kecurangan untuk meraih keuntungan yang lebih besar seperti harga jual maupun kualitas barang atau jasa tidak sesuai dengan yang diinginkan, hal ini menyebabkan kerugian terhadap konsumen. Rasa tidak puas dari konsumen akibat tindakan pelaku usaha tersebut memunculkan perselisihan diantara kedua pihak. Sehingga, perselisihan antara kedua pihak ini akan berujung pada penyelesaian sengketa di luar pengadilan, yakni di Badan Penyelesaian Sengketa Konsumen melalui proses mediasi dan arbitrase. Bagaimana pengaturan hukum tentang Badan Penyelesaian Sengketa Konsumen (BPSK) sebagai lembaga penyelesaian sengketa alternatif di Indonesia, bagaimana mekanisme penyelesaian sengketa alternatif melalui mediasi dan arbitrase di Badan Penyelesaian Sengketa Konsumen (BPSK) kota Medan, bagaimana efektivitas Badan Penyelesaian Sengketa Konsumen (BPSK) kota Medan sebagai lembaga penyelesaian sengketa alternatif melalui mediasi dan arbitrase. Metode yang digunakan dalam penelitian ini adalah yuridis normatif. Adapun penelitian ini bersifat deskriptif analisis, dengan teknik pengumpulan data dilakukan dengan tiga cara yaitu penelitian kepustakaan, penelitian lapangan, dan wawancara. Sehingga diperoleh hasil bahwa pengaturan hukum tentang Badan Penyelesaian Sengketa Konsumen (BPSK) sebagai lembaga penyelesaian sengketa alternatif di Indonesia, yaitu Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen. Mekanisme penyelesaian sengketa alternatif melalui mediasi dan arbitrase di Badan Penyelesaian Sengketa Konsumen (BPSK) kota Medan dimulai dari pengajuan permohonan (gugatan) di BPSK, pemilihan metode penyelesaian sengketa baik mediasi maupun arbitrase, dan putusan sengketa konsumen dan pelaku usaha. Efektivitas Badan Penyelesaian Sengketa Konsumen (BPSK) kota Medan sebagai lembaga penyelesaian sengketa alternatif melalui mediasi dan arbitrase sudah efektif, hal ini berdasarkan putusan yang telah disepakati oleh para pihak yang bersengketa telah menjalankan dan beritikad baik atas putusan BPSK kota Medan. BPSK kota Medan juga menyelesaikan sengketa sesuai tugas dan wewenangnya berdasarkan peraturan perundang-undangan yang berlaku. Terhadap efektivitas Badan Penyelesaian Sengketa Konsumen (BPSK) kota Medan sebagai lembaga penyelesaian sengketa alternatif diharapkan peran serta pemerintah dalam meningkatkan kinerja dan ilmu pengetahuan anggota BPSK kota Medan dengan cara memfasilitasi para mediator dan arbitor BPSK kota Medan untuk mengikuti pelatihan atau diseminasi sehingga para mediator dan arbitor BPSK kota Medan mampu memberikan berbagai pertimbangan hukum ditiap putusan yang dituangkan terhadap permasalahan-permasalahan konsumen yang beragam Business actors who take advantage of the Covid-19 pandemic situation by committing various fraudulent acts to achieve greater profits, such as the selling price or quality of goods or services are not as desired, which causes losses to consumers. Consumers' dissatisfaction due to the actions of these business actors created a dispute between the two parties. Thus, the controversy between the two parties would lead to dispute resolution out of court, namely at the Consumer Dispute Settlement Agency came through the mediation and arbitration processes. The problems of this research were how the legal arrangements regarding the Consumer Dispute Settlement Agency/Badan Penyelesaian Sengketa Konsumen (BPSK) as an alternative dispute resolution agency in Indonesia, how the alternative dispute resolution mechanism through mediation and arbitration at the Medan City Consumer Dispute Settlement Agency was, and how the effectiveness of the Medan City Consumer Dispute Settlement Agency as an alternative dispute settlement institution through mediation and arbitration was. The method used in this research was normative juridical. This research was descriptive analysis, with data collection techniques carried out in three ways, namely library research, field research, and interviews. So the results obtained were that the legal arrangement regarding the Consumer Dispute Settlement Agency as an alternative dispute settlement institution in Indonesia, namely Law Number 8 of 1999 concerning Consumer Protection. The alternative dispute settlement mechanism through mediation and arbitration at the Medan City Consumer Dispute Settlement Agency started from submitting an application (lawsuit) to it, selecting dispute settlement methods, both mediation and arbitration, and the decisions on consumer and business actor disputes. The effectiveness of the Medan City Consumer Dispute Settlement Agency as an alternative dispute settlement institution through mediation and arbitration had been effective based on a decision that had been agreed upon by the disputing parties who had carried out and had good faith on the decisions of the Consumer Dispute Settlement Agency of Medan City. It also resolved disputes following its duties and authorities based on the applicable laws and regulations. On the effectiveness of the Consumer Dispute Settlement Agency of Medan City as an alternative dispute settlement institution, hoped that the government's participation it could improve the performance and knowledge of its members by participating in training or dissemination to provide various legal considerations in every decision on various consumer problems.
