Abstract: E-commerce merupakan suatu proses berbisnis dengan memakai teknologi elektronik yang menghubungkan pelaku usaha dan konsumen dalam bentuk transaksi elektronik, pertukaran/perjualan barang, servis, dan informasi secara elektronik. Bahkan peluang yang besar dalam mendatangkan kerugian besar bagi konsumen. Seperti yang terjadi di dalam Putusan Nomor 183/PDT.G/2018/PN.Mdn. yang dianalisis ini adalah dimana permasalahannya ialah dimana pihak penjual toko (seller) yang melalui aplikasi e-commerce yakni Tokopedia melakukan transaksi jual beli. namun produknya tidak pernah diterima oleh konsumen Serta ditemukan beberapa kendala yang dihadapi dalam penyelesaian kasus tersebut. Hal ini tentunya mendatangkan sengketa, yang kemudian konsumen melalui kuasanya dalam hal ini advokat menemui kuasa hukum/pelaku usaha dalam hal sengketa yang dialaminya Permasalahan yang diangkat dalam Penelitian ini ialah apa saja Kendala yang dialami oleh Advokat dalam mengajukan gugatan terhadap kasus Jual Beli Online pada e- commerce atas haknya pada Putusan Nomor 183/Pdt.G/2018/PN.Mdn dan Bagaimana Perlindungan Hukum yang diberikan oleh Advokat atas terjadinya kasus Jual Beli Online pada Putusan Nomor 183/Pdt.G/2018/PN.Mdn. Metode penelitian pada skripsi ini adalah yuridis normatif, dengan melakukan penelitian kepustakaan (Library Research) seperti undang-undang dasar, dilengkapi dengan wawancara di kantor hukum Ramadhan & Associates. Hasil penelitian yang diperoleh adalah Mekanisme penyelesaian sengketa e-commerce dalam jual beli online dilakukan dengan 2 cara baik di dalam Pengadilan maupun diluar Pengadilan dalam hal ini dapat diselesaikan melalui Badan penyelesaian sengketa konsumen. yaitu: (1) di didalam pengadilan: PN,PM,PA,PTUN,MA,MK,. (2) diluar pengadilan: konsoliasi, mediasi, arbitrase. Kendala advokat dalam penyelesain sengketa melalui gugatan di pengadilan sebagaiamana perkara no.183/pdt.g/2018/pn.mdn, yaitu : dalam penyusunan gugatan yang diajukan identitas para pihak sangat dibutuhkan dalam hukum acara yang berlaku di indonesia. Namun tergugat dalam hal ini pelaku usaha, identitasnya hanya diketahui oleh marketplace tersebut. E-commerce is a business process using electronic technology that connects business actors and consumers in the form of electronic transactions, exchange/sale of goods, services, and information electronically. Even a great opportunity to bring big losses for consumers. As happened in Decision Number 183/PDT.G/2018/PN.Mdn. What is analyzed is where the problem is where the seller of the shop (seller) through the e-commerce application, namely Tokopedia, makes buying and selling transactions. but the product was never received by the consumer. There were several obstacles encountered in solving the case. This of course brings a dispute, which then consumers through their proxies in this case the advocate meets legal counsel/business actors in terms of the dispute they experience. The problems raised in this study are what are the obstacles experienced by advocates in filing a lawsuit against the case of buying and selling online on ecommerce. - commerce for their rights in Decision Number 183/Pdt.G/2018/PN.Mdn and How is the Legal Protection provided by Advocates for the occurrence of Online Buying and Selling cases in Decision Number 183/Pdt.G/2018/PN.Mdn. The research method in this thesis is normative juridical, by conducting library research such as the constitution, accompanied by interviews at the Ramadhan & Associates law office. The results obtained are the mechanism for resolving e-commerce disputes in online buying and selling is carried out in 2 ways, both inside the Court and outside the Court, in this case, it can be resolved through the Consumer Dispute Resolution Agency. namely: (1) in court: PN, PM, PA, PTUN, MA, MK,. (2) out of court: consolidation, mediation, arbitration. Obstacles for advocates in resolving disputes through lawsuits in court as case no. 183/pdt.g/2018/pn.mdn, namely: in the preparation of a lawsuit filed the identity of the parties is very much needed in the procedural law applicable in Indonesia. However, the defendant in this case is a business actor, whose identity is only known by the marketplace.
