Abstract: | Kepemilikan KIK menjadi rezim kekayaan intelektual yang khas yang menjadi aset masyarakat adat Nias yang menunjukkan corak keunikannya dan negara wajib memberikan Perlindungan agar tidak diambil oleh masyarakat dari wilayah lain. Dibutuhkan peran negara untuk menghadirkan Perlindungan khusus. Selain peran negara, kesadaran masyarakat mengenai pentingnya Perlindungan terhadap kekayaan intelektual komunal merupakan hal yang sangat penting. Di wilayah Pulau Nias tingkat kesadaran masyarakat adat Nias terhadap hukum khususnya pendaftaran KIK sendiri masih sangat kurang. Jenis penelitian yang digunakan adalah penelitian hukum empiris dengan data lapangan melalui wawancara kepada selaku Anggota Lembaga Adat Bawomataluo di Desa Bawomataluo Kecamatan Fanayama Kabupaten Nias Selatan. Analisis data dalam penelitian ini dilakakukan dengan cara memilih data sekunder hasil penelitian kepustakaan dan data primer hasil penelitian lapangan dianalisis secara kualitatif. Hasil penelitian ini adalah, Pertama masih belum melindungi hak masyarakat adat di Indonesia karena tidak mengatur terkait ganti rugi dan ketentuan pidana bagi pelaku yang melanggar ketentuan KIK. Kedua, Implementasi Perlindungan hukum kekayaan intelektual komunal masyarakat adat Nias sudah dilakukan dengan pendataan dan pencatatan KIK ke Direktorat Jenderal Kekayaan Intelektual. Namun, Perlindungan hukum tidak dapat diwujudkan secara efektif. Adapun alasannya dikarenakan instrumen hukumnya masih belum memadai sehingga penegakan hukum pidana terkait pelanggaran KIK tidak dapat dilakukan secara optimal guna melindungi hak masyarakat Nias dalam kepemilikan KIK atas Tari Maena, Fahombo dan Tari Faluaya. Ketiga, Upaya Pemerintah dalam melindungi hukum KIK sebagai kebutuhan masyarakat adat terhadap KIK Nias belum maksimal. Pemerintah Daerah belum menginformasikan atau mensosialisasikan manfaat pendaftaran KIK tersebut kepada masyarakat. Selain itu, Pemerintah Daerah juga kurang memperhatikan resiko para pelompat dalam atraksi lompat batu dan kurang memperhatikan kesejahteraan penari dalam menampilkan budaya tari perang. Ownership of KIK is a unique intellectual property regime which is an asset for the indigenous people of Nias which shows its unique features and the state is obliged to provide protection so that it is not taken by people from other regions. It takes the role of the state to provide special protection. In addition to the role of the state, public awareness regarding the importance of protecting communal intellectual property is very important. In the Nias Island region, the level of awareness of the Nias indigenous people regarding the law, especially KIK registration itself, is still very low. The type of research used is empirical legal research with field data through interviews with members of the Bawomataluo Customary Institution in Bawomataluo Village, Fanayama District, South Nias Regency. Data analysis in this study was carried out by selecting secondary data from library research and primary data from field research and analyzed qualitatively. The results of this study are, First, it still does not protect the rights of indigenous peoples in Indonesia because they do not regulate compensation and criminal provisions for perpetrators who violate KIK provisions. Second, the implementation of legal protection for the communal intellectual property of the Nias indigenous people has been carried out by collecting data and recording KIK at the Directorate General of Intellectual Property. However, legal protection cannot be realized effectively. The reason is because the legal instruments are still inadequate so that criminal law enforcement related to KIK violations cannot be carried out optimally in order to protect the rights of the Nias people in KIK ownership of the Maena, Fahombo and Faluaya Dances. Third, the Government's efforts to protect the KIK law as a requirement for indigenous peoples for KIK Nias have not been maximized. The Regional Government has not yet informed or socialized the benefits of KIK registration to the public. In addition, the Regional Government also pays little attention to the risks of jumpers in stone jumping attractions and pays little attention to the dancers' welfare in displaying the culture of war dance. |
