Analisis Putusan Terhadap Pelaku Tindak Pidana Penadahan Minyak Kelapa Sawit (Studi Putusan No. 238/Pid.B/2022/PN Mdn dan Putusan No. 653/Pid.B/2021/ PN Mdn)

Abstract

Industri minyak kelapa sawit merupakan industri sumber terbesar penghasil devisa non migas bagi Indonesia. Namun sering sekali terjadi kejahatan memperkaya diri, salah satunya yaitu kejahatan penadahan. Seperti yang terjadi pada putusan No. 238/Pid.B/2022/PN Mdn dan putusan No. 653/Pid.B/2021/PN Mdn. Hal tersebut merugikan perusahaan yang mengelola industri tersebut dan berpotensi mengganggu proses perusahaan pengelola dan meresahkan masyarakat. Perbuatan kedua pelaku melanggar Pasal 480 KUHPidana. Rumusan masalah dalam penelitian ini adalah Bagaimana proses pemidanaan terhadap pelaku tindak pidana penadahan minyak kelapa sawit berdasarkan putusan No. 238/Pid.B/2022/PN Mdn dan putusan No. 653/Pid.B/2021/PN Mdn dan Bagaimana pertimbangan Hakim dalam memutus perkara terhadap pelaku tindak pidana penadahan minyak kelapa sawit berdasarkan putusan No. 238/Pid.B/2022/PN Mdn dan putusan No. 653/Pid.B/2021/PN Mdn. Metode penelitian hukum yang digunakan adalah yuridis normatif. Teknik pengumpulan data dilakukan dengan penelitian pustaka dan lapangan. Berdasarkan hasil penelitian yang diperoleh disimpulkan ada faktor yang mempengaruhi jumlah hukuman pelaku penadahan, pelaku dijatuhi pidana dengan Pasal 480 ayat 2 KUHPidana pada putusan No. 238/Pid.B/2022/PN Mdn adalah pidana penjara selama 6 bulan dan Pasal 480 ayat 1 KUHPidana pada putusan No. 653/Pid.B/2021/PN Mdn adalah pidana penjara selama 2 tahun. Diharapkan dengan dijatuhi pidana penjara kepada pelaku penadahan dapat menjadi tindakan preventif sehingga kejahatan penadahan dapat berkurang. The palm oil industry is the largest non-oil and gas source of foreign exchange for Indonesia. However, crimes of enrichment often occur, one of which is the crime of fencing. It is as happened in decision no. 238/Pid.B/2022/PN Mdn and decision no. 653/Pid.B/2021/PN Mdn. This is detrimental to the company that manages the industry and has the potential to disrupt the management company's processes and disturb the public. The actions of the two perpetrators violated Article 480 of the Criminal Code. The formulation of the problem in this research was what process of punishing perpetrators of palm oil fence criminal acts based on decision No. 238/Pid.B/2022/PN Mdn and decision No. 653/Pid.B/2021/PN Mdn and what judge's considerations in deciding the case against the perpetrator of the palm oil fence criminal acts based on decision no. 238/Pid.B/2022/PN Mdn and decision no. 653/Pid.B/2021/PN Mdn. The legal research method used was normative juridical. Data collection techniques were carried out using library and field research. Based on the research results, it was concluded that some factors influenced the amount of punishment for the perpetrator of the fencing. Then, the perpetrator was sentenced to a crime under Article 480, paragraph 2 of the Criminal Code in decision No. 238/Pid.B/2022/PN Mdn was a prison sentence of 6 months, and Article 480, paragraph 1 of the Criminal Code in decision No. 653/Pid.B/2021/PN Mdn was a prison sentence of 2 years. Thus, it is hoped that being sentenced to prison for perpetrators of fencing can be a preventive measure. So, the crime of fencing can be reduced.
