Penerapan Restorative Justice Terhadap Tindak Pidana Penganiayaan Di Kepolisian Sektor Munte Polres Tanah Karo

Abstract

Indonesia adalah negara hukum. Dalam hidup di lingkungan masyarakat, tidak lepas dari aturan-aturan yang berlaku, baik aturan yang tertulis maupun aturan yang tidak tertulis.Aturan-aturan tersebut harus ditaati sepenuhnya.Adanya aturan tersebut adalah agar tercipta kemakmuran dan keadilan dalam lingkungan masyarakat. Apabila aturan-aturan tersebut dilanggar, akan mendapatkan sanksi yang tegas.Berdasarkan uraian yang telah dipaparkan di atas, maka dilakukan penelitian lebih lanjut dalam bentuk skripsi yang berjudul “Penerapan Restorative Justice Terhadap Tindak Pidana Penganiayaan Kepolisian Sektor Munte. Dalam kesempatan ini Peneliti akan menggunkan penelitian hukum kualitatif dengan melakukan pendekatan subjek penelitian dari kelompok masyarakat (Polsek Munte). Berdasarkan uraian latar belakang di atas, rumusan masalah dalam penulisan hukum ini dirumuskan, antara lain, Bagaimana penerapan konsep restorative justice terhadap penyelesaian tindak pidana penganiayaan, Apa saja hambatan yang dihadapi oleh polsek munte dalam penerapan konsep restorative justice tindak pidana penganiayaan. Dalam penelitian ini,metode penelitian yang digunakan dalam penelitian skripsi ini yaitu penelitian yuridis empiris. penulis menggunakan jenis penelitian hukum kualitatif adalah penelitian yang dilakukan dengan cara meneliti Sumber data untuk penelitian yang digunakandalam penulisan ini adalah data sekunder Penerapan Restorative Justice Terhadap Tindak Pidana Penganiayaan Di Kepolisian Sektor Munte Polres Tanah Karo telah sesuai karena memenuhi unsur subjetif. On this occasion the researcher will use qualitative legal research by approaching research subjects from community groups (Polsek Munte). In this study, the authors used a type of qualitative legal research, which is research conducted by examining correlation, descriptive, casual comparative, comparative, experimental, survey, and inferential. The data source for the research used in this writing is secondary data.
