Pencegahan Pelanggaran Desain Industri Mebel Di Kota Medan (Studi Di Kantor Wilayah Kemenkumham Sumatera Utara)

Abstract

Hak eksklusif dan perlindungan hukum atas suatu produk mebel akan didapatkan setelah Desain Industri atas produk mebel tersebut didaftarkan. Permasalahan yang diteliti adalah upaya apakah yang dapat dilakukan oleh Dirjen Hak Kekayaan Intelektual Sumatera Utara untuk mencegah pelanggaran desain industri mebel di Kota Medan dan kendala apakah yang dihadapi oleh Dirjen Hak Kekayaan Intelektual Sumatera Utara dalam upaya pencegahan pelanggaran Desain Industri di Kota Medan. Penelitian ini bersifat deskriptif analitis dengan pendekatan yuridis normatif. Metode analisis kualitatif digunakan untuk mengolah dan menganalisa data hasil penelitian. Kesimpulan: Dirjen Hak Kekayaan Intelektual Sumatera Utara telah melakukan upaya preventif dan represif dan mengadakan kerjasama pengawasan Kekayaan Intelektual dengan instansi terkait. Kendalanya adalah pengusaha mebel belum mengetahui desain mebel adalah desain industri apabila didaftarkan, maka mendapatkan perlindungan hukum dari negara, dan adanya stigma rumitnya pendaftaran desain industri. Saran: diharapkan adanya sosialisasi rutin dan terus menerus untuk menarik minat masyarakat atau pengusaha mebel untuk mendaftarkan hak Desain Industri atas produknya. Diharapkan adanya kesadaran hukum dari masyarakat akan pentingnya pendaftaran Desain Industri mebel, dan adanya kerjasama antara Dirjen Kekayaan Intelektual Kota Medan dengan lapisan masyarakat paling kecil, seperti Asosiasi atau Kumpulan Pengusaha Mebel di Kota Medan. This research is descriptive analytical with a normative juridical approach. Qualitative analysis methods are used to process and analyze research data. Conclusion: The Director General of Intellectual Property Rights in North Sumatra has carried out preventive and repressive efforts and has collaborated to supervise Intellectual Property with related agencies. The problem is that furniture entrepreneurs do not yet know that furniture designs are industrial designs. If they are registered, they will receive legal protection from the state, and there is a stigma about the complexity of registering industrial designs. Suggestion: It is hoped that there will be regular and continuous outreach to attract the interest of the public or furniture entrepreneurs to register Industrial Design rights for their products. It is hoped that there will be legal awareness from the public regarding the importance of registering furniture Industrial Designs, and there will be cooperation between the Director General of Intellectual Property of Medan City and the smallest levels of society, such as the Association or Collection of Furniture Entrepreneurs in Medan City.
