Abstract: | Memasuki dunia kerja para pekerja terkadang sering mendapatkan masalah yang salah satunya adalah masalah tentang PHK, karyawan yang terkena PHK dalam dunia kerja banyak disebabkan oleh beberapa faktor salah satunya yaitu ketidak patuhan karyawan terhadap standar operasional prosedur (SOP) yang sudah ditetapkan perusahaan, dan kewajiban perusahaan yaitu memberikan hak dan pertanggung jawaban terhadap karyawan yang terkena PHK. Adapun rumusan masalah dalam skripsi ini yaitu apakah faktor yang mempengaruhi PHK dengan tenaga Kesehatan di Klinik Pratama Fahrima, Bagaimana tanggung jawab pemilik dan pengelola terhadap PHK berdasarkan kesepakatan bersama pengelolaan Klinik Pratama Fahrima. Penelitian ini menggunakan penelitian hukum deskriptif dengan jenis penelitian normatif. Penelitian ini bertujuan untuk mengetahui faktor apa saja yang menyebabkan terjadinya PHK pada Klinik Pratama Fahrima, dan untuk mengetahui bagaimana tanggung jawab Klinik Pratama Fahrima kepada karyawan yang terkena PHK. Hasil penelitian yang di dapat yaitu Faktor penyebab terjadinya PHK pada Klinik Pratama Fahrima disebabkan karena karyawan yang kurang disiplin, tidak mematuhi standar operasional prosedur (SOP), dan adapun tanggung jawab Klinik Pratama Fahrima atas terjadinya PHK yaitu berupa kompensasi pesangon yang di hitung berdasarkan masa kerja karyawan pada Klinik Pratama Fahrima dan sesuai dengan UU No 13 Tahun 2003. Entering the world of work, workers sometimes often get problems, one of which is the problem of layoffs. Many employees who are laid off in the world of work are caused by several factors, one of which is employee non-compliance with the company's standards operating procedur (SOP) that the company has set and obligations of the company to provide rights and responsibilities to employees affected by layoffs. The formulation of the problem in this thesis is whether the factors that influence layoffs with health workers at the Fahrima Primary Clinic are the responsibilities of owners and managers for layoffs based on a mutual agreement on the management of the Fahrima Primary Clinic. This study uses descriptive legal research with normative research types. This study aims to determine what factors lead to layoffs at the Fahrima Primary Clinic and the responsibilities of the Fahrima Primary Clinic to employees affected by layoffs. The research results obtained are the factors that cause layoffs at the Fahrima Primary Clinic due to employees who lack discipline, do not comply with the company's standards operating procedur (SOP), and as for responsibility Fahrima Primary Clinic for the occurrence of layoffs, namely in the form of severance pay which is calculated based on the employee's years of service at the Fahrima Primary Clinic and by Law No. 13 of 2003. |
