Abstract: Tidak adanya kewenangan Badan Penyelesaian Sengketa Konsumen (BPSK) untuk memutuskan perkara yang berasal dari perjanjian antara lembaga pembiayaan dengan konsumen namun pada kenyataannya perkara demikian dikabulkan oleh BPSK. Berdasarkan hal tersebut, rumusan masalah dalam penelitian ini yakni : bagaimana pengaturan hukum pengajuan keberatan atas putusan BPSK, bagaimana dasar pertimbangan hakim Pengadilan Negeri Sibolga membatalkan putusan BPSK sebagaimana putusan Pengadilan Negeri Sibolga Nomor:24/Pdt.Sus-BPSK/2022/PN.Sbg dan apa faktor-faktor yang mempengaruhi penegakan hukum perlindungan konsumen. Tujuan dari penelitian ini yakni untuk memahami dan menganalisis pengaturan hukum pengajuan keberatan atas putusan BPSK, pertimbangan hakim Pengadilan Negeri Sibolga membatalkan putusan BPSK sebagaimana putusan Pengadilan Negeri Sibolga Nomor : 24/Pdt.Sus-BPSK/2022/PN.Sbg dan faktor-faktor yang mempengaruhi penegakan hukum terhadap perlindungan konsumen. Manfaat penelitian ini secara teoritis adalah menambah pengetahuan hukum penulis serta secara praktis untuk menambah wawasan pengetahuan masyarakat, lembaga pembiayaan dan penegak hukum. Adapun metode penelitian yang digunakan adalah penelitian yuridis normatif dengan teknik pengumpulan data dengan metode studi dokumen dan wawancara sedangkan analisis data menggunakan deskriptif analisis. Hasil kajian ini menunjukkan bahwa pihak yang tidak menerima putusan BPSK dapat mengajukan upaya hukum keberatan ke Pengadilan Negeri dengan mengacu pada ketentuan Pasal 56 ayat (2) Undang-Undang Nomor 8 Tahun 1999 dan PERMA Nomor 1 Tahun 2006. Upaya hukum keberatan atas Putusan BPSK dibatalkan oleh Hakim dengan pertimbangan bahwa sengketa para pihak dilatarbelakangi oleh adanya hubungan hukum perjanjian dan dugaan terjadinya cidera janji/ wanprestasi salah satu pihak. Faktor utama yang mempengaruhi penegakan hukum terhadap perlindungan konsumen yaitu faktor peraturan, faktor penegak hukum, faktor sarana dan fasilitas, dan faktor masyarakat. Untuk itu disarankan adanya penguatan atas lembaga BPSK, pemahaman hakim tentang akar permasalahan antara pelaku usaha dan konsumen serta dalam penegakan hukum perlindungan konsumen perlu peraturan yang memenuhi asas keadilan dan kepastian hukum, penegak hukum yang berkompeten, sarana dan fasilitas yang memadai, peningkatan kesadaran hukum masyarakat melalui penyuluhan hukum. The Consumer Dispute Settlement Agency (BPSK) does not have the authority to decide on cases originating from agreements between financial institutions and consumers, but in reality such cases are granted by the BPSK. Based on this, the problem formulation in this research is: what are the legal regulations for submitting objections to decisions by the BPSK; what is the basis for the Sibolga District Court judge's considerations in canceling the decision of BPSK as stated in the Sibolga District Court decision Number: 24/Pdt.Sus-BPSK/2022/PN.Sbg; and what factors influence consumer protection law enforcement. The aim of this research is to understand and analyze the legal regulations for submitting objections to the decision of the BPSK, the consideration of the Sibolga District Court judge canceling the decision of the BPSK as per the Sibolga District Court and factors that influence consumer protection law enforcement. Theoretically, the benefit of this research is to increase the author's legal knowledge and practically to increase the knowledge of the public, financing institutions and law enforcement. The research method used is normative juridical research with data collection techniques using document study and interview methods, while data analysis uses descriptive analysis. The results of this study show that parties who do not accept the decision of the BPSK can submit legal objections to the District Court by referring to the provisions of Article 56 paragraph (2) of Law Number 8 of 1999 and Supreme Court Regulation Number 1 of 2006. Legal remedies The objection to the decision of the BPSK was canceled by the Judge on the basis that the dispute between the parties was motivated by the existence of a contractual legal relationship and the alleged breach of contract/default by one of the parties. The main factors that influence law enforcement on consumer protection are regulatory factors, law enforcement factors, facilities and infrastructure factors, and community factors. For this reason, it is recommended that the institution of the BPSK be strengthened, judges understand the root of the problems between business actors and consumers and in enforcing consumer protection laws, regulations are needed that fulfill the principles of justice and legal certainty, competent law enforcers, adequate means and facilities, increased public legal awareness through legal counseling.
