Abstract: Maraknya kasus perniagaan bahan bakar tanpa izin niaga dengan menggunakan kios bernama Pertamini di kota medan dan ringannya hukuman yang diberikan hakim pada putusan yang penulis teliti membuat penulis tertarik mengangkat kasus ini menjadi bahan penelitian penulis. Permasalahan penelitian ini adalah bagaimana proses pemberian izin usaha terhadap usaha niaga bahan bakar di Indonesia dan bagaimana pertimbangan hukum oleh hakim dalam menjatuhkan sanksi pidana terhadap pelaku niaga bahan bakar tanpa izin niaga berdasarkan putusan no 5/pid.sus/2020/PN.Mdn. Metode dalam penelitian ini adalah yuridis normatif yaitu pendekatan yang dilakukan dengan cara menelaah teori. Data ini bersumber dari data sekunder yaitu sumber data yang diperoleh secara tidak langsung.Pemberian izin usaha harus memenuhi syarat yang harus dipenuhi untuk mendapatkan Izin Usaha berdasarkan Penjelasan Pasal 15 Ayat 2 Peraturan Pemerintah Republik Indonesia Nomor 36 Tahun 2004 Tentang Kegiatan Usaha Hilir Minyak Dan Gas Bumi. Pertimbangan hukum oleh hakim terhadap pelaku tindak pidana niaga bahan bakar tanpa izin niaga pada perkara putusan No.5/Pid.Sus/2020/Pn.Mdn perbuatan terdakwa telah terbukti bersalah dan memenuhi unsur tindak pidana niaga bahan bakar tanpa izin niaga , majelis hakim juga melihat adanya hal-hal/keadaan yang meringankan dan memberatkan dalam menjatuhkan putusan pidana tersebut sesuai dalam Undang-Undang No 22 Tahun 2001 tentang Minyak dan Gas Bumi. The increase in cases of fuel trading without a business trading license using a kiosk called Pertamini in Medan City and the light sentences given by judges in the verdict that the author studied made the author interested in highlighting this case as material for the author's research. The problem of this research was the process of granting a business trading license to fuel traders in Indonesia and how legal considerations were taken by judges in imposing criminal sanctions on fuel traders without a business trading license based on verdict no. 5/pid.sus/2020/PN.Mdn. The method in this research was normative juridical, namely an approach carried out by examining the theory. The data came from secondary data, i.e. indirectly obtained data sources. The granting of a business trading license must meet the requirements that must be met to obtain a business trading license based on the Explanation of Article 15 Paragraph of Government Regulation of the Republic of Indonesia Number 36 of 2004 concerning Downstream Oil and Natural Gas Business Activities. Legal consideration by the judge regarding the perpetrators of the criminal act of fuel trading business without business trading license in verdict case No.5/Pid.Sus/2020/Pn.Mdn, the defendant's actions had been proven guilty and fulfilled the elements of the criminal act of fuel trading without business trading license, the panel of judges also saw that there were mitigating and aggravating circumstances/situations in passing the criminal verdict based on Law No. 22 of 2001 concerning Oil and Natural Gas.
