Penerapan Hukum terhadap Tenaga Kerja Asing (TKA) di Kabupaten Mandailing Natal (Studi Dinas Ketenagakerjaan Kabupaten Mandailing Natal)

Abstract

Penelitian tesis ini berjudul Penerapan Hukum Tentang Penggunaan Tenaga Kerja Asing (TKA) Oleh Perusahaan Swasta (Studi Dinas Ketenagakerjaan Kabupaten Mandailing Natal). Rumusan masalahnya yakni (1) Bagaimana pengaturan hukum penggunaan tenaga kerja asing (TKA) di Indonesia? (2) Bagaimana penerapan hukum terhadap tenaga kerja asing (TKA) di Kabupaten Mandailing Natal? (3) Bagaimana bentuk perlindungan hukum yang dilakukan oleh Dinas Ketenagakerjaan Kabupaten Mandailing Natal bagi pekerja Asing (TKA) Di Kabupaten Mandailing Natal? Metode penelitian yang dipakai adalah penelitian hukum normatif, dengan tipe penelitian deskriptif analisis. Untuk pendekatan masalah menggunakan pendekatan yuridis normatif. Data yang digunakan adalah data primer dan skunder Kesimpulan dari penelitian ini yakni pengaturan hukum penggunaan tenaga kerja asing diatur dalam Undang – Undang No. 13 Tahun 2003 tentang Ketenagakerjaan, Peraturan Presiden No. 20 Tahun 2018 tentang Penggunaan Tenaga Kerja Asing, Peraturan Pemerintah No. 34 Tahun 2021 tentang Penggunaan Tenaga Kerja Asing. Bentuk perlindungan hukum yang akan dilakukan oleh Dinas Ketenagakerjaan Kabupaten Mandailing Natal bagi pekerja Tenaga Kerja Asing (TKA) Di Perusahaan Swasta yaitu membantu tenaga kerja asing dalam penyelesaian perselisihan hubungan industrial ataupun permasalahan ketika tenaga kerja asing tersebut konflik dengan Perusahaan tempat bekerjanya. Saran dari tesis ini yaitu kepada Pemerintah Kabupaten Mandailing Natal harus segera membuat Peraturan Daerah dan Peraturan Bupati tentang Tenaga Kerja Asing agar Peraturan Daerah dan Peraturan Bupati tersebut bisa diterapkan diwilayah Kabupaten Mandailing Natal. This thesis research is entitled Application of Laws Regarding the Use of Foreign Workers (TKA) by Private Companies (Study of the Mandailing Natal District Employment Service). The formulation of the problem is (1) What are the legal regulations for the use of foreign workers (TKA) in Indonesia? (2) How is the law applied to foreign workers (TKA) in Mandailing Natal Regency? (3) What form of legal protection is provided by the Mandailing Natal Regency Employment Service for foreign workers (TKA) in Mandailing Natal Regency? The research method used is normative legal research, with a descriptive analysis research type. To approach the problem using a normative juridical approach. The data used are primary and secondary data. The conclusion of this research is that the legal regulation of the use of foreign workers is regulated in Law no. 13 of 2003 concerning Employment, Presidential Regulation no. 20 of 2018 concerning the Use of Foreign Workers, Government Regulation no. 34 of 2021 concerning the Use of Foreign Workers. The form of legal protection that will be carried out by the Mandailing Natal Regency Employment Service for Foreign Workers (TKA) in Private Companies is to assist foreign workers in resolving industrial relations disputes or problems when the foreign workers are in conflict with the company where they work. The suggestion from this thesis is that the Mandailing Natal Regency Government must immediately make Regional Regulations and Regent Regulations regarding Foreign Workers so that these Regional Regulations and Regent Regulations can be implemented in the Mandailing Natal Regency area.
