Abstract: | Proses jual-beli di Indonesia ini didasari dengan adanya hukum yang mengatur seluruh masyarakat Indonesia dan merupakan salah satu jenis perjanjian yang paling sering dilakukan oleh masyarakat Indonesia, Di dalam sosial media khususnya di Facebook terdapat Black market atau dikenal pasar gelap merupakan media usaha yang banyak memperjual belikan barang - barang yang didapatkan penjual secara ilegal. Maksud dari ilegal sendiri merupakan segala hal barang yang masuk ke Indonesia tanpa melewati serangkaian proses pemeriksaan dan tidak membayar bea cukai yang telah ditentukan oleh pemerintah negara Indonesia. Rumusan masalah yakni bagaimana pengaturan tentang penjualan handphone dengan IMEI ilegal di Indonesia, dampak yang ditimbulkan atas penjualan dan pertanggungjawaban hukum bagi pelaku penjual handphone dengan IMEI Ilegal. Tujuannya penelitian ini untuk memberikan manfaat dan informasi tentang IMEI ilegal yang ada di Indonesia. Penelitian ini menggunakan metode Yuridis Normatif dan di analisis secara kualitatif yang bersumber dari data yang tidak menggunakan angka, melainkan data berupa kata-kata yang diperoleh dari wawancara, dokumentasi dan dokumen-dokumenlainnya. Hasil penelitian menunjukkan bahwa Peraturan Menteri Komunikasi dan Informatika Nomor 1 Tahun 2020 dan Undang-undang Perlindungan Konsumen, pemerintah mewajibkan semua perangkat telekomunikasi yang beredar dipasar untuk memiliki IMEI yang terdaftar secara resmi, Penjualan handphone dengan IMEI ilegal membawa dampak serius bagi berbagai aspek, baik hukum, ekonomi maupun sosial dan Pertanggung jawaban hukum bagi para pelaku ditetapkan melalui beberapa Undang-undang dan peraturan termasuk juga Undang-undang Perlindungan Konsumen, Peraturan Menteri Komunikasi dan Informatika, serta peraturan perpajakan. Pelaku dapat dijatuhi hukuman pidana berupa penjara dan denda, serta dikenakan sanksi administratif seperti pencabutan izin usaha. The buying and selling process in Indonesia is based on the existence of laws that regulate all Indonesian people and is one of the types of agreements most often made by Indonesian people. In social media, especially on Facebook, there is a Black market or known as a black market, which is a business medium that sells goods obtained by sellers illegally. The meaning of illegal itself is all goods that enter Indonesia without going through a series of inspection processes and do not pay customs duties that have been determined by the Indonesian government. The formulation of the problem is how is the regulation of the sale of mobile phones with illegal IMEIs in Indonesia, the impact of the sale and legal liability for perpetrators of selling mobile phones with illegal IMEI. The purpose of this study is to provide benefits and information about illegal IMEI in Indonesia. This study uses the Normative Juridical method and is analyzed qualitatively from data that does not use numbers, but data in the form of words obtained from interviews, documentation and other documents. The results of the study show that the Regulation of the Minister of Communication and Information Technology Number 1 of 2020 and the Consumer Protection Law, the government requires all telecommunications devices circulating in the market to have an officially registered IMEI, Sales of mobile phones with illegal IMEI have serious impacts on various aspects, both legal, economic and social and legal liability for the perpetrators is stipulated through several laws and regulations including the Consumer Protection Law, the Regulation of the Minister of Communication and Information Technology, and tax regulations. The perpetrators can be sentenced to criminal penalties in the form of imprisonment and fines, and subject to administrative sanctions such as revocation of business licenses. |
