Abstract: | Hubungan industrial yang terjalin antara buruh dan pengusaha yang dituangkan dalam perjanjian kerja ataupun secara lisan tidak selamanya berjalan mulus. Ada kalanya salah satu atau kedua belah pihak melalaikan kewajibannya dan atau tidak memenuhi haknya.Sehingga menimbulkan perselisihan hubungan industrial. Begitupula hubungan antar serikat buruh/pekerja seringkali kerap terjadi perbedaan pendapat. Perselisihan sewajarnya bisa diselesaikan secara musyawarah mufakat. Tetapi seringkali dengan jalan tersebut tidak ditemui kata sepakat, sehingga diselesaikan melalui mediator melalui Mediasi Tesis ini membahas Peranan mediator dalam mediasi perselisihan hubungan industrial sesuai Undang-undang No.2 tahun 2004 tentang penyelesaian perselisihan hubungan industrial di kantor Dinas Ketenagakerjaan Kota Medan, kendala-kendala Mediator Dinas ketenagakerjaan kota Medan dalam menyelesaikan perselisihan hubungan industrial, dan upaya mengatasi kendalakendala Mediator Dinas ketenagakerjaan kota Medan dalam menyelesaikan perselisihan hubungan industrial. Penelitian ini merupakan jenis penelitian Yuridis normatif yang bersifat deskriptif analisis, dengan pendekatan kualitatif. Jenis data yang digunakan adalah data primer dan data sekunder. Sumber data yang dipergunakan adalah sumber data primer dan sekunder. Sumber data primer diperoleh secara langsung dari Mediator di Kantor Dinas ketenagakerjaan kota Medan, sedangkan data sekunder diperoleh dari undang-undang, keputusan menteri, peraturan menteri, buku, artikel, makalah, dan media masa. Data dikumpulkan dengan teknik studi kepustakaan dan wawancara. Teknik analisis data menggunakan model interaktif. Hasil dari penelitian ini adalah peranan mediator Dinas Ketenagakerjaan kota Medan sangat penting dalam upaya penyelesaian perselisihan hubungan industrial melalui nonlitigasi di kota Medan, mediasi menekankan pada kesepakatan para pihak, sehingga tidak terdapat unsur paksaan antara para pihak. Peranan Mediator dalam menyelesaikan perselisihan hubungan industrial Dinas Ketenagakerjaan Kota Medan adalah Pengembangan hubungan industrial dan Penyelesaian perselisihan hubungan industrial di luar pengadilan melalui mediasi sesuai Undang-Undang No.2 Tahun 2004 Tentang Penyelesaian Perselisihan Hubungan Industrial. Industrial relations between workers and employers as stated in work agreements or verbally do not always run smoothly. There are times when one or both parties neglect their obligations and/or do not fulfill their rights. This causes industrial relations disputes. Likewise, relations between labor unions/workers often have differences of opinion. Disputes should be resolved through mutual consensus. But often with this path no agreement is found, so it is resolved through a mediator through MediationThis thesis discusses the Role of Mediators in Mediating Industrial Relations Disputes in accordance with Law No. 2 of 2004 concerning the Settlement of Industrial Relations Disputes at the Medan City Manpower Office, the obstacles of the Medan City Manpower Office Mediator in resolving industrial relations disputes, and efforts to overcome the obstacles of the Medan City Manpower Office Mediator in resolving industrial relations disputes.This research is a type of normative Juridical research that is descriptive analysis, with a qualitative approach. The types of data used are primary data and secondary data. The data sources used are primary and secondary data sources. Primary data sources are obtained directly from the Mediator at the Medan City Manpower Office, while secondary data are obtained from laws, ministerial decrees, ministerial regulations, books, articles, papers, and mass media. Data were collected using literature study and interview techniques. The data analysis technique uses an interactive model.The results of this study are that the role of the mediator of the Medan City Manpower Office is very important in efforts to resolve industrial relations disputes through non-litigation in the city of Medan, mediation emphasizes the agreement of the parties, so that there is no element of coercion between the parties. The role of the Mediator in resolving industrial relations disputes at the Medan City Manpower Office is the Development of industrial relations and Settlement of industrial relations disputes outside the court through mediation in accordance with Law No. 2 of 2004 concerning the Settlement of Industrial Relations Disputes |
