Efektivitas Penerapan Qanun Jinayat di Kabupaten Aceh Tengah

Abstract

Hukum Islam di Aceh, dalam penerapannya, tidak hanya mengatur akidah dan ibadah, tetapi juga mengatur tindak pidana. Saat ini, hanya beberapa tindak pidana tertentu yang diatur dalam qanun ini, termasuk khalwat (perbuatan asusila), minum minuman keras, perjudian, dan pencurian. Atas tindak pidana ini, terdakwa dikenakan hukuman cambuk di depan umum. Efektivitas penerapan hukuman cambuk ini ditegaskan oleh pelanggaran hukum Islam di wilayah hukum Kabupaten Aceh Tengah, Provinsi Aceh. Untuk mengatasi hal ini, penulis memilih judul "EFEKTIFITAS PELAKSANAAN QANUN TENTANG JINAYAT DI KABUPATEN ACEH TENGAH." Islamic law in Aceh, in its implementation, not only regulates faith and worship but also regulates criminal acts. Currently, only a few specific crimes are covered by this qanun, including khalwat (indecent acts), drinking alcohol, gambling, and theft. For these crimes, the defendant is subject to public caning. The effectiveness of the implementation of the caning penalty is emphasized by the violation of Islamic law in the jurisdiction of Central Aceh Regency, Aceh Province. To address this, the author has chosen the title "EFFECTIVENESS OF THE IMPLEMENTATION OF THE QANUN ON JINAYAT IN CENTRAL ACEH REGENCY."
