Abstract: Tindak pidana penganiayaan kerap terjadi di kepolisian merujuk pada tindakan kekerasan yang dilakukan oleh individu atau kelompok terhadap anggota kepolisian yang sedang melakukan pekerjaannya. Masalah dalam penelitian ini difokuskan pada Bagaimana pengaturan dan dampak yang timbul atas penganiayaan anggota polri menjalankan tugas yang sah, serta Bagaimana kajian kriminologi terhadap pelaku tindak pidana anggota polri berdasarkan putusan pekara pengadilan negeri medan. Penelitian ini bertujuan untuk mengetahui pengaturan dan dampak yang timbul atas penganiayaan anggota polri menjalankan tugas yang sah, serta Bagaimana kajian kriminologi terhadap pelaku tindak pidana anggota polri berdasarkan putusan pekara pengadilan negeri medan. Metode penelitian ini yaitu yuridis normatif, hasil dari penelitian ini menunjukan bahwa dalam pengaturan secara yuridis, tindak pidana penganiayaan terhadap anggota kepolisian ini diatur dalam Pasal 351 dan Pasal 212 Kitab Undang-Undang Pidana mengatur tentang penganiayaan fisik dan perlawanan terhadap pengawai negeri, adapun dampak penganiayaan mencakup luka fisik, gangguan psikologi, kesulitan dalam berkerja, serta gangguan sosial dan ekonomi bagi keluarga, kajian kriminologi berdasarkan Putusan Nomor 222/Pid.B/2024/Pn Mdn menunjukan bahwa pelaku merupakan warga sipil yang melakukan kekerasan terhadap polisi secara spontan, dengan reaksi masyarakat yang emosional sebagai bentuk kontrol sosial non formal terhadap kekerasan. Dalam hal ini penulis menggunakan teori kriminologi yaitu Differential Association dan Strain Theory The crime of persecution often occurs in the police refers to acts of violence committed by individuals or groups against members of the police who are doing their work. The problem in this study is focused on how the regulation and the impact arising from the persecution of police officers carrying out their legitimate duties, and how the criminological study of the perpetrators of criminal acts of police officers based on the decision of the Medan District Court. This study aims to determine the arrangements and impacts arising from the persecution of police officers carrying out their legitimate duties, as well as how the criminology study of the perpetrators of criminal acts of police officers based on the decision of the Medan District Court. This research method is normative juridical, the results of this study indicate that in juridical arrangements, the criminal act of mistreatment of members of the police is regulated in Article 351 and Article 212 of the Criminal Code which regulates physical mistreatment and resistance to public servants, while the impact of mistreatment includes physical injury, psychological disturbance, difficulty in working, as well as social and economic disruption for the family, criminological studies based on Decision Number 222/Pid.B/2024/Pn Mdn show that the perpetrators are civilians who commit violence against the police spontaneously, with emotional community reactions as a form of non-formal social control against violence. In this case the author uses criminological theories, namely Differential Association and Strain Theory.
