Peran Kepala Desa sebagai Mediator Penyelesaian Sengketa Tanah di Desa Benteng Kecamatan Talawi Kabupaten Batubara

Abstract

Penelitian tesis ini berjudul Peran Kepala Desa Sebagai Mediator Penyelesaian Sengketa Tanah Didesa Benteng Kecamatan Talawi Kabupaten Batubara. Rumusan masalahnya yakni (1) Bagaimana pengaturan hukum terhadap Kepala Desa menurut atauran hukum? (2) peran Kepala Desa sebagai Mediator penyelesaian sengketa tanah Di Desa Benteng Kecamatan Talawi Kabupaten Batubara? (3) Apa kendala-kendala yang dihadapi Kepala Desa sebagai Mediator penyelesaian sengketa tanah Di Desa Benteng Kecamatan Talawi Kabupaten Batubara? Metode penelitian yang dipakai yakni yuridis normatif. Hasil penelitian menunjukkan bahwa (1)aturan hukum kepala desa yakni Undang – Undang No. 6 Tahun 2014 tentang Desa, Permendagri No.112 Tahun 2014 Tentang Pemilihan Kepala Desa, Permendagri No.84 Tahun 2015 Tentang Susunan Organisasi dan Tata Kerja Pemerintah Desa, Peraturan Pemerintah No. 43 Tahun 2014 Tentang Peraturan Pelaksanaan Undang-Undang Nomor 6 Tahun 2014 Tentang Desa. (2) Peran Kepala Desa sebagai Mediator dalam menyelesaikan kasus sengketa tanah di Desa Benteng yakni Memanggil keduabelah pihak yang punya sengketa terkait kebenaran status kepemilikan tanah, Melakukan perundingan (mediasi) dengan para pihak yang terlibat terhdap sengketa tanah yang dikomandoi oleh Kepala Desa maupun aparat desa demi tercapainya kesepkatan terhadap sengketa tanah sesuai dengan bukti-bukti yang lengkap serta keterangan saksi pemilik tanahnya, Setelah adanya kesepakatan dari hasil mediasi yang telah diarahkan Kepala Desa, maka para pihak yang bersengketa membuat Surat Keputusan Desa dalam menyelesaikan sengketa tanah dan juga mengeluarkan Surat Pengakuan Tanah (SPT) bagi pihak yang benar statusnya sebagai pemilik tanah yang akan dikeluarkan oleh Kepala Desa. Kendala yang dihadapi Kepala Desa. Serta Sering sekali masyarakat tidak menerima hasil mediasi yang telah dilakukan oleh Kepala Desa sehingga masyarakat tersebut lebih memilih penyelesaiannya melalui jalur hukum ataupun jalur pengadilan. Saran dari tesis ini yakni Bila ada perselisihan atau sengketa tanah maka penyelesaiannya bisa dilakukan oleh kepala desa maupun perangkat desa lainnya. This thesis research is entitled The Role of Village Head as Mediator in Land Dispute Resolution in Benteng Village, Talawi District, Batubara Regency. The problem formulation is (1) How is the legal regulation for Village Head according to legal rules? (2) The role of Village Head as Mediator in land dispute resolution in Benteng Village, Talawi District, Batubara Regency? (3) What are the obstacles faced by Village Head as Mediator in land dispute resolution in Benteng Village, Talawi District, Batubara Regency? The research method used is normative juridical. The results of the study show that (1) the legal regulations for village head are Law No. 6 of 2014 concerning Villages, Regulation of the Minister of Home Affairs No. 112 of 2014 concerning the Election of Village Heads, Regulation of the Minister of Home Affairs No. 84 of 2015 concerning the Organizational Structure and Work Procedures of Village Governments, Government Regulation No. 43 of 2014 concerning Implementing Regulations of Law No. 6 of 2014 concerning Villages. (2) The role of the Village Head as a Mediator in resolving land dispute cases in Benteng Village is to summon both parties who have a dispute regarding the truth of land ownership status, conduct negotiations (mediation) with the parties involved in the land dispute led by the Village Head and village officials in order to reach an agreement on the land dispute in accordance with complete evidence and statements from witnesses who own the land, After an agreement from the results of the mediation that has been directed by the Village Head, the disputing parties make a Village Decree in resolving the land dispute and also issue a Land Acknowledgement Letter (SPT) for the party whose status is correct as the land owner which will be issued by the Village Head. The obstacle faced by the Village Head is the budget efficiency made by the central government and local governments in meeting the needs of facilities and infrastructure needed by the Village Head as a Mediator, so this will be a big obstacle for the Village Head as a mediator in carrying out his duties and roles. And very often the community does not accept the results of the mediation that has been carried out by the Village Head so that the community prefers to resolve it through legal channels or court channels. The suggestion from this thesis is that if there is a land dispute or dispute, the resolution can be carried out by the village head or other village officials.
