| Abstract: | Kekayaan Intelektual Komunal (KIK) merujuk pada pengetahuan tradisional, Bagaimana praktek perlindungan hukum KIK yang dilakukan negara Internasional dan praktek perlindungan hukum KIK yang dilakukan Indonesia. Penelitian ini bertujuan untuk mengetahui praktek perlindungan hukum KIK yang dilakukan negara Internasional dan praktek perlindungan hukum KIK yang dilakukan Indonesiaekspresi budaya tradisional, dan indikasi geografis yang dimiliki secara kolektif oleh komunitas adat dan lokal. Masalah dalam penelitian ini difokuskan pada. Metode penelitian yang digunakan dalam penelitian ini yaitu yuridis normatif, hasil dari penelitian ini menunjukkan bahwa Praktik perlindungan hukum KIK di tingkat internasional menekankan pengakuan hak kolektif komunitas adat atas pengetahuan tradisional, ekspresi budaya, dan sumber daya genetik melalui prinsip sukarela yang dikembangkan oleh WIPO, UNESCO, dan CBD, meski belum ada instrumen hukum yang mengikat secara global, dan Praktik perlindungan KIK di Indonesia dilakukan melalui regulasi nasional yang selaras dengan standar internasional, namun masih menghadapi tantangan dokumentasi, pemahaman masyarakat, dan penegakan hukum. Penguatan perlindungan memerlukan pendekatan hukum, edukasi, partisipasi adat, dan kerja sama global. Communal Intellectual Property (CIP) refers to traditional knowledge, traditional cultural expressions, and geographical indications that are collectively owned by indigenous and local communities. This research aims to understand the legal protection practices for CIP implemented by international entities and the legal protection practices for CIP carried out in Indonesia. The main issue in this research focuses on the comparison of these practices. The method used in this study is normative juridical. The results of the research indicate that legal protection practices for CIP at the international level emphasize the recognition of collective rights of indigenous communities over traditional knowledge, cultural expressions, and genetic resources through voluntary principles developed by WIPO, UNESCO, and the CBD, although no globally binding legal instrument currently exists. In Indonesia, CIP protection is carried out through national regulations aligned with international standards, but still faces challenges in terms of documentation, public awareness, and law enforcement. Strengthening protection requires legal approaches, education, indigenous participation, and global cooperation. |
