| Abstract: | Penegakan hukum pidana yang selama ini berorientasi pada penghukuman (retributif) dinilai kurang efektif dalam menyelesaikan perkara pidana ringan, seperti tindak pidana penganiayaan biasa. Oleh karena itu, muncul pendekatan baru yaitu Restorative Justice (keadilan restoratif) yang mengedepankan pemulihan hubungan antara pelaku dan korban secara damai. Penelitian ini bertujuan untuk menganalisis bagaimana penerapan keadilan restoratif dalam perkara penganiayaan di lingkungan Kejaksaan Tinggi Sumatera Utara serta mengidentifikasi kendala-kendala yang dihadapi dalam pelaksanaannya. Berdasarkan data yang diperoleh dari tahun 2020 hingga 2024, terdapat tren peningkatan jumlah penyelesaian perkara penganiayaan melalui pendekatan RJ, yang menunjukkan antusiasme dan perkembangan positif. Namun demikian, efektivitas pelaksanaannya masih terkendala oleh minimnya pemahaman jaksa, kendala administratif, ketidaksiapan korban atau pelaku untuk berdamai, serta tekanan dari opini publik. Oleh karena itu, penting untuk memperkuat kebijakan, pelatihan bagi aparat penegak hukum, dan membangun sistem pemantauan pasca-perdamaian agar keadilan restoratif benar-benar memberikan solusi hukum yang adil, cepat, dan menyeluruh. Criminal law enforcement in Indonesia has predominantly adhered to a retributive approach, which emphasizes punishment. However, this orientation is deemed less effective in handling minor criminal offenses, particularly cases of simple assault. As a response, the concept of Restorative Justice (RJ) has been introduced, focusing on repairing the harm and restoring relationships between the offender and the victim through peaceful resolution. This study examines the implementation of restorative justice in assault cases at the High Prosecutor’s Office of North Sumatra and identifies the challenges faced in practice. The findings, based on data from 2020 to 2024, reveal a significant increase in the number of assault cases resolved through restorative mechanisms, reflecting growing acceptance and positive development. Despite this progress, several obstacles remain, including limited understanding among prosecutors, administrative constraints, reluctance of victims or offenders to reconcile, and pressures from public opinion. The study concludes that strengthening regulatory policies, enhancing the capacity of law enforcement officers through training, and establishing a post-reconciliation monitoring system are essential to ensure that restorative justice serves as a fair, expedient, and comprehensive alternative to traditional criminal justice mechanisms. |
