| Abstract: | Penelitian ini membahas pertanggungjawaban pidana terhadap pelaku kekerasan fisik dalam rumah tangga berdasarkan Putusan Pengadilan Negeri Pematang Siantar Nomor 159/Pid.Sus/2023/PN Pms, serta menelaah pertimbangan hukum hakim dalam menjatuhkan putusan tersebut. Metode penelitian yang digunakan adalah yuridis normatif dengan pendekatan studi kasus, yang menitikberatkan pada analisis ketentuan perundang-undangan, doktrin hukum, dan fakta persidangan yang relevan. Hasil penelitian menunjukkan bahwa pelaku dikenakan pertanggungjawaban pidana berdasarkan unsur Pasal 44 ayat (1) Undang-Undang Nomor 23 Tahun 2004 tentang Penghapusan Kekerasan Dalam Rumah Tangga. Hakim mempertimbangkan fakta persidangan dan alat bukti seperti keterangan saksi, visum et repertum, serta pengakuan terdakwa. Namun, pertimbangan terhadap kondisi psikis dan latar belakang korban sebagai istri dinilai kurang optimal, sehingga menimbulkan perdebatan mengenai terpenuhinya prinsip keadilan substantif. Pengaturan hukum terhadap kekerasan fisik dalam rumah tangga di Indonesia mengacu pada UU No. 23 Tahun 2004 dan KUHP, dengan sanksi pidana yang bervariasi tergantung tingkat luka yang ditimbulkan. Undang-undang ini menempatkan KDRT sebagai pelanggaran hak asasi manusia dan bentuk diskriminasi yang wajib dihapuskan, serta menegaskan kewajiban negara untuk memberikan perlindungan hukum yang efektif kepada korban. Penelitian ini menekankan pentingnya penerapan hukum yang tidak hanya berorientasi pada pemenuhan unsur formil, tetapi juga menjamin perlindungan menyeluruh bagi korban, termasuk dukungan psikologis. Penerapan keadilan restoratif direkomendasikan sebagai alternatif penyelesaian yang mempertimbangkan kepentingan korban, rehabilitasi pelaku, dan tujuan pemidanaan dalam perspektif hukum progresif. This research examines criminal liability for perpetrators of physical domestic violence based on the Decision of the Pematang Siantar District Court Number 159/Pid.Sus/2023/PN Pms and analyzes the judicial considerations applied in determining the verdict. The study employs a normative juridical method with a case study approach, emphasizing the interpretation of statutory provisions, legal doctrines, and relevant trial facts. The findings indicate that the defendant was held criminally liable pursuant to the elements stipulated in Article 44 paragraph (1) of Law Number 23 of 2004 on the Elimination of Domestic Violence. The judge’s considerations were primarily based on trial evidence, such as witness testimonies, visum et repertum medical reports, and the defendant’s confession. However, the psychological condition and background of the victim, who was the defendant’s wife, were insufficiently addressed, raising debates about the fulfillment of substantive justice. The legal framework for addressing physical domestic violence in Indonesia is derived from Law No. 23 of 2004 and the Indonesian Penal Code (KUHP), with varying criminal sanctions depending on the severity of injuries inflicted. The law frames domestic violence as a violation of human rights and a form of discrimination that must be eradicated, while affirming the state’s obligation to provide effective legal protection for victims. This study emphasizes the necessity for law enforcement that not only ensures compliance with formal legal elements but also delivers comprehensive victim protection, including psychological support. The application of restorative justice is recommended as an alternative resolution that considers victim interests, offender rehabilitation, and the broader objectives of criminal law within a progressive legal framework. |
