| Abstract: | Penelitian ini menganalisis perbuatan melawan hukum oleh PT. Regina Mandiri Husada dalam pengelolaan limbah rumah sakit berdasarkan Putusan Nomor 663/Pdt.G/2022/PN Mdn. Tujuan penelitian adalah untuk memahami pengaturan hukum pengelolaan limbah rumah sakit, pertimbangan hakim dalam putusan tersebut, serta analisis hukum terhadap perbuatan melawan hukum. Metode penelitian menggunakan pendekatan normatif dan empiris, dengan data primer dari wawancara di Pengadilan Negeri Medan dan data sekunder dari literatur terkait. Hasil penelitian menunjukkan bahwa PT. Regina Mandiri Husada terbukti melanggar hukum karena tidak menyediakan Instalasi Pengolahan Air Limbah (IPAL) sebagai syarat utama pengelolaan limbah medis, yang diatur dalam Undang-Undang Nomor 32 Tahun 2009 tentang Perlindungan dan Pengelolaan Lingkungan Hidup serta Undang-Undang Nomor 44 Tahun 2009 tentang Rumah Sakit. Hakim memutuskan agar pembangunan rumah sakit dihentikan hingga IPAL tersedia, menegaskan pentingnya kepatuhan terhadap regulasi lingkungan. Namun, tuntutan ganti rugi ditolak karena tidak memenuhi syarat,putusan ini mencerminkan penegakan hukum lingkungan yang ketat dan prinsip in dubio pro natura (keraguan berpihak pada alam). Penelitian ini merekomendasikan peningkatan pengawasan dan sosialisasi regulasi pengelolaan limbah rumah sakit untuk mencegah pelanggaran serupa di masa depan. This study analyzes the unlawful acts committed by PT. Regina Mandiri Husada in hospital waste management based on Decision Number 663/Pdt.G/2022/PN Mdn. The objective of the research is to understand the legal framework governing hospital waste management, the judge’s considerations in the decision, and the legal analysis of the unlawful acts. The research employs both normative and empirical approaches, utilizing primary data from interviews at the Medan District Court and secondary data from related literature. The findings reveal that PT. Regina Mandiri Husada was proven to have violated the law by failing to provide a Wastewater Treatment Installation (IPAL), a mandatory requirement for managing medical waste as stipulated in Law Number 32 of 2009 concerning Environmental Protection and Management and Law Number 44 of 2009 concerning Hospitals. The court ordered the suspension of hospital construction until the IPAL was installed, emphasizing the importance of compliance with environmental regulations. However, the claim for damages was rejected due to failure to meet legal requirements. This ruling reflects strict enforcement of environmental law and the application of the principle in dubio pro natura (when in doubt, favor nature). The study recommends enhancing supervision and dissemination of regulations on hospital waste management to prevent similar violations in the future. |
