| Abstract: | Penelitian dilatarbelakangi pentingnya peran Majelis Pengawas Daerah Notaris (MPDN) dalam mengawasi notaris agar patuh pada hukum dan kode etik. MPDN menghadapi kendala, terutama terkait notaris yang tidak melaporkan akta, yang mengancam akuntabilitas profesi. Penelitian bertujuan untuk mengetahui Peranan Majelis Pengawas Daerah Notaris Terhadap Notaris yang Tidak Melaporkan Akta. Jenis penelitian yuridis normatif, sifat penelitian kualitatif menggunakan bahan hukum primer, sekunder, tersier, teknik pengumpulan data melalui penelitian kepustakaan dan penelitian lapangan. Kesimpulan hasil penelitian pengaturan notaris yang tidak melaporkan akta mengacu pada UUJN dan Permenkumham No. 24 Tahun 2018. Notaris wajib membuat dan menyimpan minuta akta (Pasal 16 UUJN), serta melaporkan alamat kantor dan tanda tangan dalam 60 hari setelah sumpah jabatan (Pasal 5 Permenkumham). Pelanggaran terhadap kewajiban ini dapat dikenai sanksi administratif (Pasal 66 UUJN). MPDN berperan penting dalam mengawasi pembuatan akta oleh notaris agar sesuai dengan hukum dan kode etik. Berdasarkan UUJN, MPDN berwenang meminta keterangan, mengawasi protokol notaris, dan menerima pengaduan masyarakat. Jika ditemukan pelanggaran, MPDN dapat memberikan peringatan atau merekomendasikan sanksi kepada Majelis Pengawas Wilayah. Praktiknya, MPDN menghadapi sejumlah kendala, di antaranya adalah terbatasnya akses terhadap informasi mengenai akta yang tidak dilaporkan, keterbatasan anggaran dan sumber daya manusia, kesulitan dalam proses pembuktian. This research is motivated by the important role of the Regional Supervisory Council of Notaries (Majelis Pengawas Daerah Notaris or MPDN) in overseeing notaries to ensure their compliance with the law and professional code of ethics. MPDN faces challenges, particularly regarding notaries who fail to report the deeds they have made, which threatens the accountability of the profession. The study aims to examine the role of MPDN toward notaries who do not report their deeds. This is a normative juridical research using a qualitative approach, relying on primary, secondary, and tertiary legal materials. Data collection techniques include library research and field research. The conclusion of the research shows that the regulation concerning notaries who fail to report deeds refers to the Notary Position Act (UUJN) and the Regulation of the Minister of Law and Human Rights No. 24 of 2018. Notaries are required to prepare and keep the original deeds (minuta akta) (Article 16 UUJN), and report their office address and signature sample within 60 days after taking the oath of office (Article 5 of the Ministerial Regulation). Violations of these obligations may lead to administrative sanctions (Article 66 UUJN). MPDN plays a crucial role in supervising notarial deeds to ensure compliance with legal provisions and ethical standards. According to UUJN, MPDN is authorized to request information, oversee notarial protocols, and receive public complaints. If violations are found, MPDN may issue warnings or recommend sanctions to the Regional Supervisory Council. However, in practice, MPDN faces several obstacles, including limited access to information about unreported deeds, insufficient budget and human resources, and difficulties in the process of proof. |
