| Abstract: | Tindak pidana pencemaran nama baik merupakan perbuatan pidana yang menyerang nama baik dalam sebuah ucapan, kalimat dan media yang menyerang kehormatan orang lain. Tujuan penelitian ini adalah untuk mengetahui pengaturan hukum tindak pidana pencemaran nama baik di media elektronik di Indonesia, faktor penyebab tindak pidana pencemaran nama baik di media elektronik dalam putusan Nomor: 776/Pid.Sus/2022/PN Mdn dan prosedur persidangan tindak pidana pencemaran nama baik di media elektronik di Pengadilan Negeri Medan. Jenis penelitian yang digunakan adalah penelitian normatif, dengan jenis data yang berasal dari bahan hukum primer, sekunder dan bahan hukum tersier. Data dikumpulkan dengan menggunakan teknik studi kepustakaan dan studi lapangan, serta dianalisis secara kualitatif. Hasil penelitian menunjukkan bahwa Pengaturan mengenai tindak pidana pencemaran nama baik telah diatur dalam Pasal 27 ayat (3) yang telah diperbarui menjadi Pasal 27A jo Pasal 45 ayat (4) UU Nomor 1 Tahun 2024 tentang Perubahan Kedua Undang-Undang ITE. Faktor penyebab pencemaran nama baiksalah satunya adalah perkembangan teknologi digital, ketidakpahaman etika komunikasi, dan kebebasan berekspresi yang salah kaprah. Dalam penerapan pertanggungjawaban pidana terhadap pelaku, unsur-unsur seperti adanya perbuatan pidana, kemampuan bertanggung jawab, adanya unsur kesalahan, serta tidak ditemukannya alasan pemaaf menjadi kunci utama. Defamation is a criminal offense that attacks a person's reputation through speech, writing, or media that attacks the honor of others. The purpose of this study is to examine the legal framework governing defamation crimes in electronic media in Indonesia, the causes of defamation crimes in electronic media as outlined in Judgment No. 776/Pid.Sus/2022/PN Mdn, and the trial procedures for defamation crimes in electronic media at the District Court of Medan. The type of research used is normative research, with data sourced from primary, secondary, and tertiary legal materials. Data was collected using literature review and field study techniques and analyzed qualitatively. The research results indicate that regulations regarding criminal defamation are stipulated in Article 27 paragraph (3), which has been updated to Article 27A in conjunction with Article 45 paragraph (4) of Law No. 1 of 2024 concerning the Second Amendment to the ITE Law. One of the factors causing defamation is the development of digital technology, a lack of understanding of communication ethics, and a misguided sense of freedom of expression. In applying criminal liability to perpetrators, key elements include the existence of a criminal act, the ability to be held responsible, the presence of fault, and the absence of mitigating circumstances. |
