Tinjauan Hukum Tindak Pidana Eksploitasi Seksual terhadap Anak (Studi Putusan Nomor 2207/Pid.Sus/2022/PnMedan)

Abstract

Tindak pidana Eksploitasi seksual terhadap anak didefinisikan sebagai tindakan yang mengarahkan atau memanfaatkan anak untuk melakukan kegiatan seksual, Berdasarkan latar beiakang masalah di atas, maka penulis akan menjadikan pokok permasalahan Bagaimara Pengaturan Hukum Terhadap Tindak Pidana Ekspolitasi Terhadap Anak. Bagaimana Pertimbangan Hukum Terhadap Tindak Pidanan Ekspoloitas Terhadap Anak Dalam (Studi Putusan Nomor 2207/Pid.Sus/2022/PnMedan). Metode penelitian skripsi ini menggunakan jenis penelitian yuridis normatif, menggunakan bahan hukum primer dan sekunder, dengan sifat penelitian deskriptif analisis dan menggunakan teknik pengumpulan data dengan cara melakukan penelitian kepustakaan (Library Research) dan lapangan (FieldResearch). Berdasarkan hasil penelitian penulis, Pengaturan Hukum Terhadap Tindak Pidana Ekspolitasi Terhadap Anak. terdapat beberapa hal yang perlu diperhatikan. Putusan ini mengungkap bahwa Terdakwa telah terbukti melakukan tindak pidana eksploitasi seksual terhadap seorang anak, yang merupakan pelanggaran terhadap Undang-Undang Perlindungan Anak. Pertimbangan Hukum Terhadap Tindak Pidanan Ekspoloitas Terhadap Anak Dalam (Studi Putusan Nomor 2207/Pid.Sus/2022/PnMedan), anak mempunyai hak-hak yang yang harus dilindungi. Hak-hak anak dalam hal ini diatur dalam Pasal 13 UU No. 23 Tahun 2002 Tentang Perlindungan anak. Pasal 64 dan Pasal 65 UU No. 39 Tahun 1999 Tentang Hak Asasi Manusia. Pasal 64 : “setiap anak berhak untuk memperoleh perlindungan dari kegiatan eksploitasi ekonomi dan setiap pekerjaan yang membahayakan dirinya, sehingga dapat mengganggu pendidikan, kesehatan fisik, moral, kehidupan sosial, dan mentyal spiritualnya” The crime of sexual exploitation of children is defined as an act that directs or exploits a child to engage in sexual activity. Based on the background of the problem above, the author will address the main issue of How the Law Regulates the Crime of Exploitation of Children and What Legal Considerations Are There for the Crime of Exploitation of Children in (Study of Decision Number 2207/Pid.Sus/2022/PnMedan). The research method of this thesis uses a normative juridical research type, using primary and secondary legal materials, with a descriptive analytical research nature and using data collection techniques by conducting library research (Library Research) and field research (Field Research). Based on the results of the author's research, Legal Regulations on Criminal Acts of Exploitation of Children. There are several things that need to be considered. This decision reveals that the Defendant has been proven to have committed a criminal act of sexual exploitation of a child, which is a violation of the Child Protection Law. Legal Considerations Regarding Criminal Acts of Exploitation of Children In (Study of Decision Number 2207 / Pid.Sus / 2022 / PnMedan), children have rights that must be protected. Children's rights in this case are regulated in Article 13 of Law No. 23 of 2002 concerning Child Protection. Article 64 and Article 65 of Law No. 39 of 1999 concerning Human Rights. Article 64: "Every child has the right to protection from economic exploitation and any work that is hazardous to their health and may interfere with their education, physical health, morals, social life, and mental and spiritual well-being."
