| Abstract: | Kerusakan hutan merupakan permasalahan krusial yang tidak hanya mengakibatkan kerugian materiil, tetapi juga dampak ekologis kompleks yang sulit dipulihkan. Mengingat penegakan hukum pidana semata dinilai belum memadai untuk mengembalikan fungsi lingkungan hidup, maka penerapan instrumen hukum perdata melalui gugatan ganti kerugian menjadi sangat vital. Penelitian ini bertujuan menganalisis pelaksanaan prosedur penuntutan ganti kerugian perdata oleh Balai Penegakan Hukum Kehutanan Wilayah Sumatera, hambatan dalam pembuktian kerugian ekologis, serta upaya penyelesaiannya. Studi ini menggunakan metode penelitian hukum empiris bersifat deskriptif kualitatif, dengan data yang diperoleh melalui wawancara mendalam terhadap penyidik dan staf serta dokumen regulasi terkait. Hasil penelitian mengindikasikan bahwa prosedur penuntutan umumnya dimulai setelah pembuktian tindak pidana dinyatakan lengkap, dengan menerapkan prinsip tanggung jawab mutlak (strict liability) berdasarkan Pasal 88 Undang-Undang Nomor 32 Tahun 2009. Kendati demikian, proses ini menghadapi hambatan signifikan, meliputi kondisi geografis yang sulit dijangkau, keterbatasan jumlah ahli bersertifikasi, serta perbedaan persepsi mengenai metode penghitungan kerugian di pengadilan yang sering diperdebatkan tergugat. Sebagai solusi, dilakukan optimalisasi manajemen saksi ahli melalui Surat Keputusan Direktur Jenderal, peningkatan kapasitas penyidik melalui pelatihan rutin, serta penguatan kerja sama dengan Kejaksaan Tinggi demi efektivitas penegakan hukum. Forest destruction as crucial issue causing not only material losses but also complex ecological impacts that are difficult to restore. Since criminal law enforcement alone is considered insufficient to restore environmental functions, the application of civil law instruments through compensation claims becomes vital. This research aims to analyze the implementation of civil compensation procedures by the Law Enforcement Agency for Environment and Forestry of Sumatra Region, obstacles in proving ecological losses, and resolution efforts. This study employs an empirical legal research method with a descriptive qualitative nature, obtaining data through in-depth interviews with investigators and staff alongside document es of related regulations. Results indicate that the prosecution procedure generally commences after the criminal offense is proven complete, applying the strict liability principle based on Article 88 of Law Number 32 of 2009. However, this process faces significant obstacles, including inaccessible geographical conditions, a limited number of certified experts, and differing perceptions regarding loss calculation methods in court often disputed by defendants. As solutions, the agency optimizes expert witness management through Director General Decrees, increases investigator capacity through routine training, and strengthens cooperation with the High Prosecutor's Office for effective law enforcement. |
