Abstract: Perjanjian kredit merupakan instrumen penting dalam perekonomian, namun memiliki risiko inheren berupa wanprestasi yang dapat merugikan kreditur. Penelitian ini dilatarbelakangi oleh kasus wanprestasi pada fasilitas Kredit Usaha Pedesaan (KUPEDES) di mana debitur gagal memenuhi kewajibannya dengan alasan kegagalan usaha, yang berujung pada gugatan di Pengadilan Negeri Medan. Tujuan penelitian ini adalah untuk menganalisis bentuk pertanggungjawaban hukum debitur menurut KUHPerdata, dasar pertimbangan hakim dalam memutus wanprestasi pada Putusan No.54/Pdt.G/2024/PN Mdn, serta akibat hukum terkait pembayaran sisa utang dan eksekusi agunan Hak Tanggungan. Penelitian ini menggunakan metode yuridis empiris dengan sifat deskriptif analisis. Data diperoleh melalui studi dokumen terhadap putusan pengadilan, peraturan perundang-undangan, dan standar operasional prosedur (SOP) perbankan, serta wawancara dengan pihak Pengadilan Negeri Medan. Hasil penelitian menunjukkan bahwa bentuk pertanggungjawaban hukum debitur meliputi kewajiban membayar ganti rugi berupa biaya, kerugian, dan bunga sesuai Pasal 1243 KUHPerdata, serta pelunasan sisa utang secara seketika (lunas seketika). Dasar pertimbangan hakim menyatakan debitur wanprestasi didasarkan pada bukti Surat Pengakuan Hutang yang berkedudukan sebagai confessie debet dan adanya surat peringatan (somasi) yang diabaikan. Hakim menolak dalil kegagalan usaha sebagai force majeure karena risiko bisnis bukan merupakan keadaan memaksa menurut hukum. Akibat hukum bagi debitur adalah hilangnya hak untuk mengangsur, kewajiban pengosongan objek jaminan, dan eksekusi lelang agunan Hak Tanggungan dengan hak mendahulu (droit de preference) bagi bank untuk pelunasan piutang. Credit agreements are essential instruments in the economy but carry inherent risks of default which can cause losses to creditors. This research is motivated by a default case in the Rural Business Credit (KUPEDES) facility where the debtor failed to fulfill obligations due to business failure, leading to a lawsuit at the Medan District Court. The objective of this study is to analyze the form of debtor legal liability under the Civil Code (KUHPerdata), the judge's legal considerations in declaring default in Decision No.54/Pdt.G/2024/PN Mdn, and the legal consequences regarding the payment of remaining debts and the execution of Mortgage Rights collateral. This study employs a juridical-empirical method with a descriptive analysis nature. Data were obtained through document studies of court decisions, regulations, and banking standard operating procedures (SOP), as well as interviews with the Medan District Court. The results indicate that the debtor's legal liability includes the obligation to pay compensation in the form of costs, damages, and interest pursuant to Article 1243 of the Civil Code, as well as immediate full repayment of the remaining debt. The judge's consideration in declaring the debtor in default was based on the Debt Acknowledgement Letter serving as confessie debet and the ignored warning letters (somasi). The judge rejected the argument of business failure as force majeure, as business risks do not constitute a force majeure event under the law. The legal consequences for the debtor include the loss of the right to pay in installments, the obligation to vacate the collateral object, and the execution of the Mortgage Rights auction with preferential rights (droit de preference) for the bank to settle the receivables.
