Abstract: Penerapan alasan pembelaan terpaksa (noodweer) dalam sistem peradilan pidana Indonesia menghadapi tantangan baru seiring berlakunya KUHP Baru (Undang Undang No. 1 Tahun 2023). Meskipun diakui sebagai alasan penghapus pidana, dalam praktiknya sering terjadi penafsiran dalam membedakan antara pembelaan yang sah dengan tindakan main hakim sendiri atau pembelaan yang melampaui batas (noodweer exces). Tujuan dari penulisan ini adalah untuk menganalisis pengaturan hukum pembelaan terpaksa dalam KUHP Baru. Faktor utama yang menjadi parameter adalah kondisi terdesak untuk melindungi nyawa atau harta benda, serta mengevaluasi pertimbangan hakim di Pengadilan Negeri Medan dalam menerapkan sanksi pidana terhadap pelaku yang menggunakan alasan tersebut. Metode penelitian yang digunakan adalah yuridis normatif dengan dukungan data primer, sekunder, dan tersier. Teknik pengumpulan data dilakukan melalui studi pustaka dan studi lapangan. Hasil penelitian menunjukkan bahwa Pengaturan Pembelaan Terpaksa dalam Pasal 34 KUHP Baru mengakui pembelaan terpaksa sebagai alasan pembenar jika memenuhi syarat adanya serangan seketika serta prinsip proporsionalitas dan subsidiaritas. Faktor utamanya adalah kondisi mendesak untuk mempertahankan nyawa atau harta benda tanpa adanya ruang waktu untuk berpikir. Pertimbangan hakim menegaskan bahwa pembelaan tidak boleh berlebihan. Jika serangan telah berhenti tetapi pelaku terus melukai korban, tindakan tersebut dikategorikan sebagai noodweer exces atau tindak pidana murni. The application of the defense of necessity (noodweer) in the Indonesian criminal justice system faces new challenges with the enactment of the New Criminal Code (Law No. 1 of 2023). Although recognized as a reason for criminal exoneration, in practice, multiple interpretations often occur in distinguishing between legitimate defense and vigilantism or excessive defense (noodweer excess). The purpose of this paper is to analyze the legal provisions for defense of necessity in the New Criminal Code. The main factor that serves as a parameter is the urgent condition to protect life or property, and to evaluate the considerations of judges at the Medan District Court in imposing criminal sanctions on perpetrators who use this reason. The research method used is normative juridical supported by primary, secondary, and tertiary data. Data collection techniques were carried out through literature studies and field studies. The results of the study indicate that the Regulation of Defense of Need in Article 34 of the New Criminal Code recognizes defense of need as a justification if it meets the requirements of an immediate attack and the principles of proportionality and subsidiarity. The main factor is the urgent condition to defend life or property without any time to think. The judge's considerations emphasized that the defense must not be excessive. If the attack has stopped but the perpetrator continues to injure the victim, the act is categorized as noodweer excesses, or a purely criminal act.
