| Abstract: | Korupsi dana desa merupakan salah satu bentuk tindak pidana korupsi yang masih marak terjadi di Indonesia, seiring dengan meningkatnya alokasi Dana Desa dan Alokasi Dana Desa (ADD) pasca berlakunya Undang-Undang Nomor 6 Tahun 2014 tentang Desa. Perangkat desa sebagai penyelenggara pemerintahan di tingkat paling bawah memiliki tanggung jawab besar dalam pengelolaan keuangan negara, namun dalam praktiknya masih ditemukan penyalahgunaan wewenang yang merugikan keuangan negara, sebagaimana tercermin dalam Putusan Pengadilan Negeri Medan Nomor 119/Pid.Sus-TPK/2025/PN Mdn. Penelitian ini bertujuan untuk menganalisis pengaturan hukum tindak pidana korupsi dalam peraturan perundang-undangan di Indonesia serta mengkaji pertimbangan hukum hakim dalam menerapkan sanksi pidana terhadap perangkat desa yang melakukan tindak pidana korupsi. Metode penelitian yang digunakan adalah penelitian hukum normatif dengan pendekatan perundang-undangan dan pendekatan kasus, melalui analisis bahan hukum primer dan sekunder. Hasil penelitian menunjukkan bahwa pengaturan hukum terkait tindak pidana korupsi di Indonesia telah cukup komprehensif, namun penerapannya di tingkat desa masih menghadapi berbagai kendala, terutama terkait pengawasan dan efektivitas sanksi pidana. Putusan hakim dalam perkara tersebut dinilai belum sepenuhnya memberikan efek jera dan keadilan substantif, mengingat besarnya kerugian negara dan posisi strategis pelaku sebagai aparatur desa. Village fund corruption is one form of corruption offense that remains widespread in Indonesia, along with the increasing allocation of Village Funds and Village Fund Allocations (ADD) following the enactment of Law Number 6 of 2014 on Villages. Village officials, as administrators of government at the lowest level, bear significant responsibility in managing state finances; however, in practice, abuses of authority that cause losses to state finances are still frequently found, as reflected in the Medan District Court Decision Number 119/Pid.Sus-TPK/2025/PN Mdn. This study aims to analyze the legal regulation of corruption offenses under Indonesian laws and regulations, as well as to examine judges’ legal considerations in imposing criminal sanctions on village officials who commit corruption offenses. The research method employed is normative legal research using a statutory approach and a case approach, through the analysis of primary and secondary legal materials. The results of the study indicate that the legal framework governing corruption offenses in Indonesia is relatively comprehensive; however, its implementation at the village level continues to face various obstacles, particularly in terms of supervision and the effectiveness of criminal sanctions. The court’s decision in this case is considered not to have fully provided a deterrent effect and substantive justice, given the magnitude of state losses and the strategic position of the perpetrator as a village official. |
