Abstract: Restorative Justice merupakan model pendekatan baru dalam proses penyelesaian perkara pidana. Penyelesaian perkara melalui Restorative Justice berfokus pada keikutsertaan secara langsung pelaku, korban, serta masyarakat dalam penyelesaian perkara tindak pidana. Penyelesaia perkara dengan restorative justice dapat dilakukan pada tindak pidana ringan seperti tindak pidana penganiayaan. Tujuan dari penelitian ini adalah untuk mengetahui pengaturan hukum tentang restorative justice, penyelesaian perkara tindak pidana penganiayaan melalui restorative justice, serta kendala kepolisian sektor mardingding dalam penerapan restorative justice. Metode penelitian yang digunakan yaitu Normatif-Empiris. Hasil dari penelitian ini menunjukkan bahwa dalam penerapan restorative justice pada perkara tindak pidana penganiayaan ringan berpedoman pada Peraturan Kepolisian No 8 Tahun 2021 tentang Penyelesaian perkara tindak pidana berdasarkan keadilan restoratif. Penyelesaian perkara dapat dilaksanakan apabila memenuhi syarat formil dan materil. Hambatan yang timbul dalam penerapan restorative justice antara lain tidak tercapainya kesepakatan mengenai ganti kerugian, adanya permasalahan sebelumnya serta ketidakpuasaan dengan sistem restorative justice. Adanya hambatan yang timbul pada penyelesaian perkara dengan restorative justice menjadi tugas besar bagi pihak kepolisian untuk dapat mencari solusi sehingga restorative justice dapat dijadikan sebagai alternatif penyelesaian perkara yang dapat memberi keadilan dan kemanfaatan bagi semua pihak yang berperkara. Restorative Justice is a new approach model in the process of resolving criminal cases. The resolution of cases through Restorative Justice focuses on the direct involvement of the perpetrator, victim, and community in the settlement of criminal offenses. The application of restorative justice can be implemented in minor criminal offenses, such as minor assault. The purpose of this study was to examine the legal framework of restorative justice, the settlement of minor assault cases through restorative justice, and the challenges faced by the Mardingding Police Sector in implementing restorative justice. The research method used was Normative-Empirical. The results of this study indicated that the implementation of restorative justice in minor assault cases was guided by Police Regulation No. 8 of 2021 concerning the Settlement of Criminal Cases Based on Restorative Justice. The settlement of cases could be carried out if formal and material conditions were met. Obstacles in the implementation of restorative justice included the failure to reach an agreement on compensation, the existence of prior issues, and dissatisfaction with the restorative justice system. The challenges that arose in the settlement of cases through restorative justice presented a significant task for the police to find solutions so that restorative justice could be used as an alternative dispute resolution method that provided justice and benefits to all parties involved.
