Abstract: Penelitian ini bertujuan untuk mengkaji sengketa hukum terkait analisis hukum atas keberatan Pt. Pln (Persero) Up3 Medan terhadap putusan badan penyelesaian sengketa konsumen di pengadilan negeri medan dengan studi putusan nomor 428/PDT.SUS-BPSK/2023/PN.MDN. Dalam kegiatan usaha, hubungan antara konsumen dan pelaku usaha tidak selalu berjalan lancar sehingga dapat menimbulkan suatu sengketa. Sengketa tersebut dapat diselesaikan di bpsk seperti yang terjadi pada putusan bpsk kota medan nomor 022/Arbitrase/2023/BPSK.Mdn. Dalam putusan tersebut, Pt. Pln (Persero) Up3 Medan melakukan P2TL terhadap marihot tampubolon karena diduga melakukan pelanggaran penggunaan arus listrik, setelah diakukannya P2TL, marihot tampubolon mengadukan sengeketa tersebut kepada BPSK kota medan. Guna mendekati masalah ini dipergunakan teori pendekatan yuridis normatif. Data dikumpulkan melalui studi pustaka dan wawancara dengan hakim yang memutus perkara, lalu dianalisis secara kualitatif. Dalam putusan, bpsk kota medan memutuskan dengan mengabulkan gugatan konsumen, menghukum pelaku usaha, melepaskan gugatan denda, dan menyatakan Pt. Pln (Persero) Up3 Medan melanggar sop. Atas putusan bpsk tersebut, Pt. Pln (Persero) Up3 Medan mengajukan permohonan keberatan kepada pengadilan negeri medan. Setelah permohonan keberatan diterima,pengadilan negeri medan memeriksa serta memutuskan bahwa bpsk tidak berwenangan dalam menangani perkara tersebut. Putusan hakim menyatakan bahwa bpsk kota medan tidak berwenang dalam menangani perkara tersebut berdasarkan pasal 1 angka 7 Undang undang ketenagalistrikan, Konsumen adalah setiap orang atau badan yang membeli tenaga listrik dari pemegang izin usaha penyediaan. Hasil penelitian menyimpulkan bahwa putusan bpsk dapat di uji lagi dengan mengajukan permohonan keberatan terhadap pengadilan negeri sesuai dengan pasal 56 undangundang no. 8 tahun 1999 tentang perlindungan konsumen. This study aims to examine legal disputes related to the legal analysis of the objection of Pt. Pln (Persero) Up3 Medan against the decision of the consumer dispute resolution body at the Medan District Court with a study of decision number 428 / PDT.SUS-BPSK / 2023 / PN.MDN. In business activities, the relationship between consumers and business actors does not always run smoothly so that it can cause a dispute. The dispute can be resolved at the BPSK as happened in the Medan City BPSK decision number 022 / Arbitrase / 2023 / BPSK.Mdn. In the decision, Pt. Pln (Persero) Up3 Medan carried out a P2TL against Marihot Tampubolon because he was suspected of violating the use of electricity, after the P2TL was carried out, Marihot Tampubolon reported the dispute to the Medan City BPSK. In order to approach this problem, the normative legal approach theory was used. Data were collected through literature studies and interviews with judges who decided the case, then analyzed qualitatively. In the verdict, the Medan City BPSK decided to grant the consumer's lawsuit, punish the business actor, waive the fine claim, and declare that Pt. Pln (Persero) Up3 Medan violated the SOP. Based on the BPSK's decision, Pt. Pln (Persero) Up3 Medan filed an objection to the Medan District Court. After the objection was received, the Medan District Court examined and decided that the BPSK was not authorized to handle the case. The judge's decision stated that the Medan City BPSK was not authorized to handle the case based on Article 1 number 7 of the Electricity Law, Consumers are every person or entity that purchases electricity from the holder of a business license for the provision of electricity. The results of the study concluded that the BPSK's decision can be tested again by filing an objection to the district court in accordance with Article 56 of Law no. 8 of 1999 concerning consumer protection.
