Perlindungan Jaminan Sosial Ketenagakerjaan Bagi Pengemudi Sepeda Motor (Driver) Berbasis Aplikasi Online (Studi di PT. Grab Teknologi Indonesia Cabang Medan)

Abstract

Jaminan sosial ketenagakerjaan dimaksudkan untuk memberikan perlindungan bagi tenaga kerja terhadap risiko sosial-ekonomi yang menimpa tenaga kerja dalam melakukan pekerjaan baik berupa kecelakaan kerja, sakit, hari tua, maupun meninggal dunia. Belum adanya asuransi terhadap keselamatan para pekerja (pengemudi) ojek online saat melakukan pekerjaannya mengakibatkan kurangnya perlindungan dalam hal keselamatan kerja yang diberikan perusahaan terhadap para pekerjanya, padahal angka kecelakaan di jalan terutama untuk sepeda motor terus meningkat setiap tahunnya. Berdasarkan hal tersebut maka peneliti mengambil rumusan permasalahan yaitu bagaimana pengaturan hukum terhadap perlindungan keselamatan pengguna sepeda motor untuk kepentingan masyarakat Indonesia, bagaimana bentuk perlindungan hukum terhadap pengemudi transportasi online berbasis aplikasi berdasarkan Peraturan Menteri Perhubungan (Permenhub) Nomor 12 Tahun 2019 tentang Pelindungan Keselamatan Pengguna Sepeda Motor yang digunakan untuk Kepentingan Masyarakat serta bagaimana kepastian hukum perlindungan jaminan sosial ketenagakerjaan bagi pengemudi sepeda motor berbasis aplikasi untuk kepentingan masyarakat. Sifat penelitian ini digunakan dalam menyelesaikan skripsi ini adalah analisis berdasarkan hukum positif yang mengarah kepada penelitian hukum yang normatif. Pengaturan hukum terhadap perlindungan keselamatan pengguna sepeda motor untuk kepentingan masyarakat Indonesia diwadahi dengan Permenhub Nomor 12 Tahun 2019. Perlindungan hukum terhadap pengemudi ojek online sudah sesuai dengan Permenhub Nomor 12 Tahun 2019. Dalam Pasal 16 ayat (3) Permenhub Nomor 12 Tahun 2019 juga telah mengatur tentang perlindungan terhadap pengemudi sepeda motor untuk kepentingan masyarakat yang dilakukan dengan aplikasi yaitu kepastian mendapatkan santunan jika terjadi kecelakaan, dan kepastian mendapatkan perlindungan jaminan sosial ketenagakerjaan dan jaminan sosial kesehatan sesuai dengan peraturan perundang-undangan. Bentuk perlindungan penyedia jasa layanan ojek online kepada pengemudi ojek online adalah berupa asuransi serta santunan baik dari dana perusahaan maupun pengumpulan donasi dari pengemudi ojek online yang lainnya. Selain itu, penyedia jasa layanan ojek online memberikan pilihan kepada mitranya untuk mendaftarkan diri pada perusahaan asuransi yang bekerjasama dalam mewujudkan perlindungan. Employment social security is intended to provide protection for workers against socio-economic risks that befall workers in doing work in the form of work accidents, illness, old age, and death. The absence of insurance for the safety of online motorcycle taxi workers (drivers) when doing their work results in a lack of protection in terms of work safety provided by the company to its workers, even though the number of road accidents, especially for motorcycles continues to increase every year. Based on this, the researcher took a formulation of the problem, namely how to regulate the law on the protection of the safety of motorcycle users for the benefit of the Indonesian people, how is the form of legal protection for application-based online transportation drivers based on the Regulation of the Minister of Transportation (Permenhub) Number 12 of 2019 concerning Protection of the Safety of Motorcycle Users used for the Benefit of the Community and how is the legal certainty of social security protection of employment for application-based motorcycle drivers for the benefit of the community. The nature of this research used in completing this thesis is an analysis based on positive laws that lead to normative legal research. Legal regulations for the protection of the safety of motorcycle users for the benefit of the Indonesian people are accommodated by Permenhub Number 12 of 2019. Legal protection for online motorcycle taxi drivers is in accordance with Minister of Transportation Regulation Number 12 of 2019. Article 16 paragraph (3) of Permenhub Number 12 of 2019 has also regulated the protection of motorcycle drivers for the benefit of the community which is carried out with applications, namely the certainty of getting compensation in the event of an accident, and the certainty of getting social security protection for employment and health social security in accordance with laws and regulations. The form of protection of online ojek service providers to online ojek drivers is in the form of insurance and compensation both from company funds and collection of donations from other online ojek drivers. In addition, online motorcycle taxi service providers give their partners the option to register with insurance companies that cooperate in realizing protection.
